- Sweden has no specific law regarding cyberstalking, even though technology is a prominent part of everyday society. There is a lack of research concerning cyberstalking within the Swedish context. This study aims to examine the legal norms involving cyberstalking. Specifically how the existing legal norms are reproduced, as well as to see if the legal and social norms have an interdependence and which factors that contribute to said interdependence. The ultimate goal is to generate a broader knowledge about cyberstalking within the Swedish society. - Sweden has no specific law regarding cyberstalking, even though technology is a prominent part of everyday society. There is a lack of research concerning cyberstalking within the Swedish context. This study aims to examine the legal norms involving cyberstalking. Specifically how the existing legal norms are reproduced, as well as to see if the legal and social norms have an interdependence and which factors that contribute to said interdependence. The ultimate goal is to generate a broader knowledge about cyberstalking within the Swedish society. This will be executed through a literature review on district court judgements in three cities located in the south of Sweden, the law itself and academic research. The methodological approach is combined with a critical discourse analysis and Cristina Bicchieri:s work regarding social norms. The literature review revealed several legal norms within both the district court judgements and the law, including the propositions to the law. The law is vague, and cyberstalking occur less frequently in the law, but occurs to a higher degree in the legal practice. The academic research utilized and analysed established that the legal and social norms correlated in various ways with various factors. Some of these were the representation of the perpetrator and the victims of cyberstalking and the relationship between the two parties within the district court judgements. The analysis concluded that there is a need for a greater extent of research regarding cyberstalking, both with a position grounded in sociology of law but also within the Swedish context. (Less)
