Human Rights Diplomacy: The Case of Cambodia

Abstract
This paper is initiated to analyze the trade related human rights diplomacy of the European Union (EU) and the United States (US) in Cambodia. In doing so, the thesis is conducted to provide definition and tools of the human right diplomacy that have been utilized by State and Non-State actors at all level. This paper is initiated to analyze the trade related human rights diplomacy of the European Union (EU) and the United States (US) in Cambodia. In doing so, the thesis is conducted to provide definition and tools of the human right diplomacy that have been utilized by State and Non-State actors at all level. The thesis also examines the human rights situations in Cambodia with the focus on labour related rights particularly the right to freedom of expression and association and the right to peaceful assembly that were among the reasons leading to the recent decision of the EU Commission to propose partial withdrawal of Everything But Arms (EBA) trade preference and introduction in the US of the trade bill on Cambodia. At the same time, the thesis also explores the reactions and measures taken by the Cambodian government and non-governmental institutions in responding to the human rights diplomacy of the EU and the US.

This study finds that the mechanism of human rights diplomacy has evidently contributed to the promotion and protection of human rights in various parts of the world. Among the three main tools of human right diplomacy: criticism, persuasion and support of grass root actions, the last two of which are more favorable by States subject to these actions and produce more positive and long lasting impacts.

In the case study of Cambodia, the thesis finds that Cambodian government has made a positive progress toward her internal reforms and commitment to her human rights obligations in accordance with the Constitution, national law and international conventions she has ratified. However, there are also remaining human rights issues that have concerned local and international actors including the human rights organizations, partnering States, the UN Special Rapporteur on the human rights situation in Cambodia and the EU among others.
Last but not least, the thesis concludes that the human rights diplomacy via trade conditionalities of the EU and US have influenced and encouraged the Cambodian government toward implementation of her human rights obligations. (Less)
