- Studien är en diskursanalys av statens språkbruk i rättsfallet mellan samebyn Girjas och svenska staten i Högsta domstolen. Girjas stämde staten år 2009 i Gäl-livare tingsrätt och ärendet avslutades i Högsta domstolen i Stockholm år 2020. Girjas fick ensamrätt på jakt och fiske på samebyns område, vilket gör att de lättare kan förvalta rennäringen i samband med jakten och fisket. Sverige har blivit kritiserat internationellt för att brista i att erkänna samernas anspråk på urfolksrättigheter. Under rättegången har kritik också uppkommit nationellt. Svenska statens diskurs präglades av rasistiska uttryck och av underliggande maktstruk-turer där staten ville avgöra vilka näringar som tillhör samiska traditioner. Ge-nom ett sådant språkbruk kan staten också bestämma när samers rättigheter kan åsidosättas för andra nationalekonomiska intressen. Studien visar att staten inte bemöter samernas anspråk på urfolksrättigheter i Girjas-fallet, trots att fallet gäl-ler traditionella samiska näringar. Girjas-fallet är ett exempel där maktobalansen synliggörs och samiska anspråk på urfolksrättigheter nekas. (Less)

- This study analyses the discourse used by the Swedish state in the trial between the Saami village of Girjas and the Swedish state in the Swedish Supreme court. Girjas sued the State for the first time in 2009, and then took the case to the su-preme court in 2020. The people of Girjas won the hunting and fishing rights on the land in question thanks to the concept of prescription from time immemorial. Sweden has received international attention for its ill treatment of the Saami in-digenous people. This specific trial gained the attention of the Swedish media for the State’s language usage. - This study analyses the discourse used by the Swedish state in the trial between the Saami village of Girjas and the Swedish state in the Swedish Supreme court. Girjas sued the State for the first time in 2009, and then took the case to the su-preme court in 2020. The people of Girjas won the hunting and fishing rights on the land in question thanks to the concept of prescription from time immemorial. Sweden has received international attention for its ill treatment of the Saami in-digenous people. This specific trial gained the attention of the Swedish media for the State’s language usage. The study will show examples of comments made by the State’s representatives based on a theoretical framework focusing on rights claims, racism and internal colonisation. The analysis of this discourse shows that the State wants to have the power to decide what is or is not included in Saami traditions. With that power the State can decide which claims are indige-nous claims and therefore decide when Saami interests should be minimized in favour of other national interests. This shows a misuse of power and exploitation of unjust power relations. The study shows that the Swedish state still fails to recognize the Saami people’s rights according to international law. This is due to a lack of incorporation into Swedish law of international conventions regarding indigenous rights. The long history between the Saami people and the Swedish state seems to be repeating itself while the State continues to hold a discriminato-ry view of the Saami people. (Less)
