Häktningar, restriktioner och isolering - varför är inte Sverige bättre?

Abstract
Sweden has over time faced criticism for its use of restrictions, such as isolation, for remand prisoners and also the long times that suspects are being held awaiting trial. The purpose of this paper is to investigate what makes the Swedish justice system stand out when compared to fellow Nordic countries.

To fullfil the purpose of this paper Sweden’s, Norway’s and Denmark’s legislations have been systematically examined and compared to find relevant differences. The sources that have been used are legislation and preparatory works, but some guidance have also been found in academic literature.

Sweden has over time faced criticism for its use of restrictions, such as isolation, for remand prisoners and also the long times that suspects are being held awaiting trial. The purpose of this paper is to investigate what makes the Swedish justice system stand out when compared to fellow Nordic countries.

To fullfil the purpose of this paper Sweden’s, Norway’s and Denmark’s legislations have been systematically examined and compared to find relevant differences. The sources that have been used are legislation and preparatory works, but some guidance have also been found in academic literature.

The main part that makes Sweden stand out against Denmark and Norway is the lack of limitations for how long a suspect can be held in isolation and in remand prison. A point of interest is that all three countries have had similar principles and opposing interest to deal with when drafting the legislation, but found quite different solutions.

The paper also feature a case study to examine if it is the practical side of Swedens juridical process that’s causing the heightened use of remand prison and isolation. The results of the case study can be summarized as the rulings following a clear template with limited use of motivations, making it hard to draw any conclusions.

As there are changes on the way these have been examined to see if they may hold the key to some of the problems that have been discovered. Many of these solutions bring the Swedish legislations closer to that of Denmark and Norway, but miss out on the opportunity to develop further. (Less)

Sverige har över tid mött kritik för långa häktningstider och omfattande användning av restriktioner, främst isolering. Uppsatsens syfte är att undersöka vad det är som gör att just Sverige sticker ut jämfört med våra grannländer.

För att uppfylla uppsatsen syfte har gällande rätt sammanställts för de tre länderna, Sverige, Danmark och Norge, med hjälp av den rättsdogmatiska metoden. Dessa har sedan jämförts genom en begränsad komparativ metod för att utläsa på vilka sätt Sverige särskiljer sig. Materialet som har använts har främst varit lagtext och förarbeten, men även till viss del doktrin som vägledning.

Sammanfattningsvis sticker Sverige ut vad gäller lagstiftning genom att svensk rätt i mindre omfattning än grannländerna begränsar tiden som en misstänkt får hållas häktad så väl som isolerad. Detta är intressant eftersom Danmark och Norge haft i stort sett samma principer och motstående intressen att ta hänsyn till, men kommit fram till annorlunda lösningar.

En fallstudie har också genomförts för att utreda om det är en slentrianmässig behandling av beslut om häktning och restriktioner som kan tänkas ligga bakom att Sverige har högre siffror vad gäller detta än sina grannländer. Resultatet av studien kan sammanfattas med att besluten tycks följa en tydlig mall samt att motiveringar i besluten är begränsade. Detta gör det svårt att dra några slutsatser från resultatet.

Då det finns förändringar på gång har dessa undersökts för att se om dessa kan tänkas lyckas med att lösa de problem som upptäckts. Många av dessa lösningar för oss närmare våra grannländers, men tar inte till vara på möjligheten att utvecklas ytterligare. (Less)
