- Den fria bevisprövningen, innehållande dels den fria bevisföringen, dels den fria bevisvärderingen, är en grundprincip inom den svenska processrätten. Med tiden har utvecklingen gått mot allt fler inskränkningar i principen om den fria bevisföringen. Utvecklingen kan bidra till att vi kan fråga oss huruvida vi ska börja prata om en begränsad bevisföring istället för en fri sådan.
Syftet med uppsatsen är att utreda undantagen från den fria bevisföringen och huruvida det går att ifrågasätta om principen verkligen är fri eller inte. För att besvara syftet innehåller uppsatsen en redogörelse för den fria bevisföringens reglering i svensk rätt. Uppsatsen innehåller också en redogörelse för olika inskränkningar som begränsar den fria bevisföringen.
Genom undersökningen och beskrivningen av gällande rätt dras slutsatsen att det finns utrymme för att ifrågasätta huruvida den fria bevisföringen verkligen är fri i den svenska rätten. Dock, sett till uppsatsens omfång, är det inte möjligt att dra slutsatsen att bevisföringen är begränsad som huvudregel. (Less) - Abstract
- A fundamental principle in Swedish procedural law is that both the submitting of evidence by the parties before the court and the evaluation of the evidence by the court, should be free in the sense that it is not regulated by law. With time the tendency has gone towards more restrictions of the principle that the submitting of evidence should be free. The tendency can contribute to the question of however the principle in fact is restricted, rather than free.
The purpose of the essay is to investigate the restrictions of the principle that the submitting of evidence should be free and whether it is possible to question whether the principle is actually free or not. To be able to answer the purpose, the essay includes an account of the... To be able to answer the purpose, the essay includes an account of the regulation of the principle in Swedish law. The essay also includes an account of different restrictions to the principle.
Through the findings of the analysis the conclusion that the essay arrives at is that it is possible to question whether the principle is actually free in the Swedish law. However, due to the word restriction of the essay, it is not possible to come to the conclusion that the principle that the submitting of evidence should be free is not to be recognized as the “main rule”.
