I samband med att den nya förvaltningslagen (2017:900) (FL) trädde i kraft
2018 så infördes en så kallad dröjsmålstalan genom 12 § FL. Syftet med
bestämmelsen är att enskilda ska få ett verktyg för att kunna påskynda
handläggningen av ett ärende i det fall som processen präglas av oskäliga
dröjsmål. 12 § FL har dock kommit att kritiseras. Redan under
remissbehandlingen påpekade ett flertal instanser att förfarandet inte var
ändamålsenligt och efter att 12 § FL trätt i kraft har bestämmelsen fördömts i
media.

Denna uppsats syftar till att undersöka huruvida utformningen av 12 § FL

handläggningen av ett ärende i det fall som processen präglas av oskäliga
dröjsmål. 12 § FL har dock kommit att kritiseras. Redan under

ändamålsenligt och efter att 12 § FL trätt i kraft har bestämmelsen fördömts i

Denna uppsats syftar till att undersöka huruvida utformningen av 12 § FL
utgör ett effektivt rättsmedel ur den enskildes perspektiv och därmed
uppfyller sitt tilltänkta syfte. Den slutsats som kan dras av undersökningen är
att det finns ett flertal aspekter där bestämmelsen bör ändras för att bättre
uppfylla sitt syfte. För det första bör dröjsmålstalan ska kunna väckas mer än
en gång under en handläggningsprocess. För det andra så bör alla typer av
ärenden där en enskild är part omfattas av 12 § FL. För det tredje bör
dröjsmålstalan utformas utifrån en avslagsmodell. Detta innebär att i det fall
myndigheten inte vidtar åtgärder inom en angiven tidsram så anses ett fiktivt
avslagsbeslut ha meddelats i ärendet. Detta avslag kan sedan överklagas av
den enskilda.

Med bakgrund i vad som framkommit i undersökningen är det dock tveksamt
om dröjsmålstalan även med ovannämnda förändringar kan komma att utgöra
ett effektivt verktyg i mer än enstaka fall. I majoriteten av fallen anges
orsaken till oskäliga dröjsmål vara organisatoriska aspekter och därför
riskerar 12 § FL att endast bli ett sätt för den enskilde att på formell väg belysa
dessa problem snarare än att lösa dem. På grund av olika anledningar finns
det snarare en risk för att dröjsmålstalan leder till en högre arbetsbelastning
som i sin tur förlänger de redan långa handläggningstiderna. (Less)

As the new Administrative Procedure Act came in to force in 2018 a new
remedy was introduced to counteract the inaction of administrative
authorities. Its aim is to provide individuals with an opportunity to enforce a
decision within four weeks when the processing of an errand has been
unreasonably delayed. Already during the stage of development, the remedy
was criticized for its inability to fulfill its purpose. After the remedy came in
to force it also has been subject to criticism in the media for the same reason.

The aim of the essay is to evaluate if the remedy is an effective instrument
from an individual’s point of view. The examination is primarily based on the

theoretical point of view, is that the remedy in its current form requires
altering to better fit its purpose and to be an effective measure from an
individual’s point of view. First, an individual should be able to appeal to the
new remedy more than once during the process. Second, the right of appeal
should be extended to all kinds of errands regardless of who the initiator is.
Third, if the authority is inactive for a given period the application should be
considered as rejected. This rejection can later be an issue of an appeal.

However, it can be questioned if the remedy itself efficiently can solve the
problem with the inaction of administrative authorities even with the
suggested alterations. The delays are described to be caused by organizational
factors and therefore the remedy risks to not solve any problem but just to
illustrate its existence – that never have been questioned. Therefore, there is
a fear that the new remedy only will cause a higher workload and due to this
only lengthen the already long processing time that is caused by the inaction
of the authorities. (Less)
