Intermittenta anställningar, eller tim-/behovsanställningar, blir allt vanligare på svensk arbetsmarknad trots att arbetsformen saknar rättslig definition i lagtext. Uppsatsen syftar till att undersöka vad intermittenta anställningar innebär och vilket anställningsskydd som intermittent anställda erhåller. Utredningen genomförs med utgångspunkt i rättsdogmatisk metod. Fokus ligger även på de intresseavvägningar som det rättsliga materialet speglar och vad avvägningarna får för konsekvenser i praktiken. Uppsatsen behandlar anställningsskyddet i Lag (1982:80) om anställningsskydd (LAS) samt två EU-direktiv, en avgränsning som lämnar kollektivavtal och övrig lagstiftning åt sidan.

Uppsatsen syftar till att undersöka vad intermittenta anställningar innebär och vilket anställningsskydd som intermittent anställda erhåller. Utredningen genomförs med utgångspunkt i rättsdogmatisk metod. Fokus ligger även på de intresseavvägningar som det rättsliga materialet speglar och vad avvägningarna får för konsekvenser i praktiken. Uppsatsen behandlar anställningsskyddet i Lag (1982:80) om anställningsskydd (LAS) samt två EU-direktiv, en avgränsning som lämnar kollektivavtal och övrig lagstiftning åt sidan.
I uppsatsen utreds definitionen av intermittenta anställningar samt arbetsformens position på arbetsmarknaden. Det förs även en diskussion kring den otrygghet som intermittenta anställningar medför genom det svaga anställningsskyddet. Inledningsvis ges en historisk redogörelse kring anställningsskyddets framväxt i relation till olika anställningsformer. Följande kapitel behandlar specifikt intermittenta anställningar. I kapitlet utreds arbetsformens definition, främst utifrån Arbetsdomstolens praxis. Vidare presenteras anställningsskyddet enligt LAS. Det konstateras att anställningsskydd för intermittent anställda i LAS är svagt. Det skydd som finns att tillgå är, till följd av sättet att beräkna anställningstid, svårare att erhålla som intermittent anställd än genom andra tidsbegränsade anställningar och tillsvidareanställning. Diskussion förs även kring huruvida intermittenta anställningar kan utgöra tillsvidareanställning och vad det i så fall skulle innebära för anställningsskyddet. Vidare behandlas visstids3- respektive deltidsdirektivet4 i syfte att undersöka om direktiven kan stärka anställningsskyddet för intermittenta anställningar. Diskussionen berör dels principen om icke- diskriminering, dels kravet på effektiva åtgärder för att förhindra missbruk av på varandra följande visstidsanställningar. Det konstateras att diskrimineringsbestämmelserna framstår som bristfälliga i sammanhanget men att anställningsskyddet potentiellt skulle kunna stärkas genom att hävda missbruk av på varandra följande visstidsanställningar. Casual Employments are becoming more frequent at the Swedish labour market. However, the term is not mentioned in Swedish labour legislation. The aim of this thesis is to investigate the signification of Casual Employments and the degree of security of employment that Casual employees receives. By using a Legal-Dogmatic method, focus lies on the balance of interests that are reflected through the presented material. The Employment Protection Act (anställningsskyddslagen, LAS, SFS 1982:80) and two EU directives forms the foundation of the thesis, which limits the scope of the thesis from further investigations in areas such as Collective Agreements and remaining legislation.

This thesis examines the definition of Casual Employments and the position of this form of employment at the labour market. Firstly, a historical review of the development of employment security in relation to permanent and fixed-term employment is presented. Additionally the same chapter includes an exposition of different forms of employment. Secondly, one chapter focuses entirely on Casual Employments, mainly by investigating case law from the Swedish Labour Court. Thirdly, the employment security regulation according to LAS is accounted for. It is established that the protection for Casual Employments is poor, primarily because of the disadvantaged way that one counts the period of service for Casual Employees. A discussion regarding if Casual Employments can constitute permanent Employments, and in that case what that would mean for the employment security, is also pursued.
Lastly, the fixed-term work directive1 and the part-time work directive2 is presented with the purpose of examining whether the directives can be used to strengthen the Swedish employment security for Casual Employments. The discussion includes the principle of non- discrimination and the demand for effective measures to present abuse of successive fixed-term employment contracts. It is concluded that the regulation of non-discrimination appears to be insufficient for the purpose of the thesis, but that the employment security potentially could be strengthened by claiming abuse of successive fixed-term employment contracts.
