Surrogatarrangemang har varit kraftigt debatterat i Sverige. I dagens läge finns ingen reglering på området. Surrogatarrangemang sker dock ändå genom att svenskar åker utomlands eller utför heminsemination. Detta innebär att barn tillkommer men det finns ingen reglering som hanterar dess rättsliga förhållanden.

Syftet med uppsatsen är att undersöka om en framtida reglering av altruistiskt surrogatarrangemang kan skydda surrogatmodern och barnet på ett tillfredställande sätt. Syftet med uppsatsen är att undersöka om en framtida reglering av altruistiskt surrogatarrangemang kan skydda surrogatmodern och barnet på ett tillfredställande sätt. Altruistiskt surrogatmoderskap innebär att ingen ersättning utgår till surrogatmodern utöver eventuella graviditetsrelaterade kostnader. Vidare är syftet att identifiera olika problem som kan uppstå vid en framtida eventuell reglering av surrogatmoderskap. Syftet med uppsatsen är slutligen att komplexiteten i frågan om surrogatarrangemang tydligt ska framträda.

Uppsatsen begränsas till svensk rätt och altruistiskt surrogatmoderskap med fokus är att undersöka ämnet utifrån surrogatmodern och barnets perspektiv.

För att uppnå uppsatsens syften använder jag mig av en rättsdogmatisk metod och ett kritiskt perspektiv i övrigt. Materialet i uppsatsen utgörs huvudsakligen av förarbeten, rapporter och avhandlingar.

Eftersom Sverige inte har någon lagstiftning som reglerar surrogatmoderskap uppstår en del problem. Rättsfallet NJA 2006 s. 505 är ett exempel på detta då ett syskonpar blev rättsliga föräldrar till ett barn. Detta eftersom att i Sverige räknas den kvinna som föder barnet som dess moder enligt moderskapspresumtionen.

Surrogatarrangemang undersöks i uppsatsen från tre olika infallsvinklar: etiskt perspektiv, barnets bästa och avtalet. Surrogatarrangemang är etiskt komplicerat då bland annat kvinnans rätt till självbestämmande kan tala både för att surrogatarrangemang ska vara tillåtet och att det ska vara förbjudet. Ur barnets perspektiv är det också av intresse att utreda om det är etiskt godtagbar med surrogatarrangemang. Inför en framtida reglering är det också viktigt att undersöka om surrogatarrangemang är förenligt med barnets bästa enligt FNs barnkonvention.

Utformningen vid avtalet av surrogatarrangemang är vidare av stor vikt. Surrogatmoderns rätt att få bestämma över sin kropp exempelvis vid abort och rätten att få ångra sig är viktig att reglera. Frågan om ersättning vid arbetsbortfall under graviditet likaså.

I analysen dras slutsatsen att inför en framtida reglering av surrogatarrangemang krävs mer forskning för att kunna ge surrogatmodern och barnet tillräckligt med skydd. Vidare pekas på problem som kan uppstå inför en eventuell reglering. Det konstateras också att det är ett svårreglerat område med flera parters intressen som ska balanseras mot varandra. (Less)

Surrogacy arrangements have been heavily debated. Today, there is no legislation regarding surrogacy arrangements in Sweden. However, the phenomena still take place by Swedes going abroad or performing private insemination. This leaves the legal situation for families with surrogate-born children uncertain.

The purpose of the thesis is to examine whether a future regulation of altruistic surrogate arrangement would be able to protect the surrogate mother and the child in a satisfactory manner. Altruistic surrogacy means that no compensation is paid to the surrogate mother in addition to any pregnancy-related costs. However, the phenomena still take place by Swedes going abroad or performing private insemination. This leaves the legal situation for families with surrogate-born children uncertain.

The purpose of the thesis is to examine whether a future regulation of altruistic surrogate arrangement would be able to protect the surrogate mother and the child in a satisfactory manner. Altruistic surrogacy means that no compensation is paid to the surrogate mother in addition to any pregnancy-related costs. Furthermore, the purpose is to identify various problems that may arise facing a possible future regulation of surrogacy. The purpose of the thesis in finally that the complexity of the issue of surrogate arrangements should be clearly stated.

The thesis is limited to Swedish law and altruistic surrogacy with a focus on examining the subject from the perspective of the surrogate mother as well as that of the child.

To achieve the purpose of the thesis, I use a legal dogmatic method and a critical perspective in general. The material in the thesis consists mainly of preparatory work to Swedish legislation, reports and dissertations.
Since Sweden do not have any legislation on surrogacy, some problems arise. The case NJA 2006 s. 505 from Swedish Supreme Court is an example of this, where a couple of siblings became the legal parents of a child. This happened because in Sweden the woman who gives birth to the child is the legal mother according to the presumption of maternity.

Surrogate arrangements are examined in the essay from three different angles: ethical perspective, the best interests of the child and the agreement. Surrogate arrangements are ethically complicated as, among other things, the woman’s right to self-determination can be used to argue for both that surrogate arrangements should be allowed and that they should be prohibited. From the child’s perspective, it is also of interest to investigate whether surrogacy arrangements are ethically acceptable.

Before a future regulation, it is also important to investigate whether surrogate arrangements are compatible with the child’s best interests according to the UN Convention on the Rights of the Child.

The formulation of the agreement on surrogate arrangements is also of great importance. The surrogate mother’s right to decide over her body, for example in event of an abortion; and the right to repent are important to regulate. It is also important to regulate the compensation in the event of unemployment as an indirect consequence of the surrogate arrangement.

The analysis concludes that before a future regulation on surrogate arrangement is made, more research is required in order to provide the surrogate mother and the child with sufficient protection. Furthermore, points are made of problems that may arise prior to a future regulation. It is also stated that it is a difficult area to regulate as the interests of several parties that must be balanced against each other. (Less)
