Skada i förhållande till LVU - vid avvägningar mellan barnets bästa och återföreningsprincipen

Den 1 januari 2020 inkorporerades barnkonventionen till svensk lag. Inkorporeringens bakomliggande syfte ska ha varit att beslutsfattare nu ska ta barnets bästa i större beaktning än vad som tidigare har gjorts. Ett område där barnets bästa har en stor betydelse är beslutsfattande inom LVU.

Uppsatsens syfte är att utreda hur beslutsfattandet inom LVU förhåller sig till barnets bästa. I LVU ligger ett stort fokus på skadan, vilket resulterar i att uppsatsen analyserar hur domstolarna ser på skadan och hur skadan är kopplad till barnets bästa och återföreningsprincipen. Ett antal olika rättsfall analyseras, varav ett är det omtalade fallet om Esmeralda.

Uppsatsens syfte är att utreda hur beslutsfattandet inom LVU förhåller sig till barnets bästa. I LVU ligger ett stort fokus på skadan, vilket resulterar i att uppsatsen analyserar hur domstolarna ser på skadan och hur skadan är kopplad till barnets bästa och återföreningsprincipen. Ett antal olika rättsfall analyseras, varav ett är det omtalade fallet om Esmeralda.

En kartläggning görs av vad som krävs för vård och upphörande av vård enligt LVU. Det analyseras även vad barnet har för rättigheter. För att ett barn ska vårdas enligt LVU krävs att det föreligger en påtaglig risk för barnets hälsa eller utveckling ska skadas. Hur ett barn faktiskt kan skadas skiljer sig ofta mellan barn till barn, precis som det skiljer sig stort mellan vad som är barnets bästa. Genomgången av rättsfall syftar till att utreda hur skadan tolkas i olika fall och hur man ser på skadan i förhållande till återförening med biologiska föräldrar.

Det görs en mindre analys om lagändringen som ska börja gälla 1 mars 2021 kommer att resultera i annorlunda beslut. Förhoppningen är att beslutsfattare kommer att överväga vårdnadsöverflyttningar i större utsträckning än vad de tidigare har gjort, om det anses vara barnets bästa. Regeringen hoppas att detta ska resultera i en större trygghet för barnen.

Barn är enskilda individer med olika bakgrund. Därför är det inte är möjligt att ha en bestämmelse eller allmän uppfattning om hur ett barn tar skada eller vad som är barnets bästa. Det hade resulterat i en allt för snäv bestämmelse, istället måste en individuell prövning göras i varje enskilt fall.

I slutet av uppsatsen problematiseras två faktum. I första hand att återföreningsprincipen är en allmän målsättning som kan leda till att föräldrarätten blir starkare än barnrätten. Den allmänna målsättningen torde ersättas av att syftet alltid, enbart ska vara barnets bästa och ingenting annat. Sedan kan barnets bästa visa sig vara återföreningsprincipen. I andra hand problematiseras att skadan ett barn kan lida vid en återförening inte har någon större betydelse, när detta kan få en stor inverkan på barnets hälsa och utveckling. (Less)

On the 1st of January 2020, the UN convention on the Rights of the Child was incorporated into Swedish law. The purpose of the incorporation was to make the decision maker officers take the best interest of the child in a bigger consideration than they have done before. A series of legal cases are being analyzed, one in particular is the much-discussed case about Esmeralda.

A mapping is done of what it takes to get care and to stop the care according to LVU. There is also an analysis of what rights the children has. In order to get a child treated according to LVU, there must be noticeable risk of the child’s health or development to suffer. There is often a difference in how a child can get hurt, just as there is a big difference between what actually is the best interest of a child. The analysis of the different legal cases has the purpose of investigating how the court understands the injury in different cases. It also analyzes how the injury is related to the principle of reuniting a child with its biological parents.

There is also a minor discussion about if the amendment of the law that is going to change from the 1st of march 2021 will result in different decisions. The hope is that the decision makers will take a bigger consideration in transferring the custody to the family home than they have done before, if it is in the best interest of the child. The ministry hope that it will result in a bigger safety for the children.

Every child is their own individual with different backgrounds, which makes it impossible to have a general regulation of how a child can get hurt or what is the best interest of all children. Having that, would result in a too narrow regulation. Instead there must be an examination of every individual.

In the end of the essay there are two problems mentioned. First of all, having the principle of reuniting a child with its biological parents as a general purpose might lead the right of the parents to be stronger than the right of the children. The general purpose should be replaced by only focusing on the best interest of the child and nothing else. Second of all, another problem is that the injury a child can get from moving home to its biological parents is not being taken in any bigger consideration, when it in fact can have substantial bearing on the child’s health and development.
