At the beginning of 2020, the ”Little heart” case received a lot of media attention. The case illustrates the tension between child protection, reunification and continuity that is built into the compulsory care of children. Firstly, the legislation must secure children's right to protection – even from their parents. At the same time, children have a right to their parents, even if the child has had to be separated from them for protection reasons. At the beginning of 2020, the ”Little heart” case received a lot of media attention. The case illustrates the tension between child protection, reunification and continuity that is built into the compulsory care of children. Firstly, the legislation must secure children's right to protection – even from their parents. At the same time, children have a right to their parents, even if the child has had to be separated from them for protection reasons. Due to that fact, the child's protection interest must be balanced against the interest in maintaining contact with the biological parents during the period of care and the interest of being reunited with them when the care ceases. In addition, there is an interest in ensuring continuity and stability in the child's existence that can contradict a reunion with the biological parents – especially in long-term placements in foster homes. The balance between the aforementioned interests is at its utmost during the termination of compulsory care.

The purpose of this thesis is to examine and analyze how the balance of interests between, on the one hand, reunification with the biological parents, and on the other hand continuity and stability in the foster home, is handled at the end of compulsory care. To achieve the purpose of the thesis, a legal dogmatic method has been used to determine the applicable law, while a legal analytical method has been used to analyze the law from a child rights perspective.

The examination of applicable law shows that the balancing of interests is handled through different set of rules and different processes – termination of care, prohibition on removal and transfer of custody to the foster parents. The starting point for the termination of care is that the child is to be reunited with his or her biological parents, and there is therefore no balance of interests between reunification and continuity within the framework of section 21 of LVU (the 1990 Act with Special Provisions on the Care of Young Persons). However, if the child is at risk of any harm or injury as a result of the separation from the foster home, a conflict of interest arises between reunification and continuity. This conflict of interest is handled separately within the framework of prohibition on removal in section 24 of LVU and/or transfer of custody in Chapter 6, section 8, of the Parental Code – which aims to satisfy the child's need for continuity in the foster home.

In this thesis, both the assessment processes and the regulations themselves are considered to be questionable from a child rights perspective. (Less)

I början av år 2020 fick fallet “Lilla hjärtat” stor medial uppmärksamhet. Fallet illustrerar spänningen mellan skydd, återförening och kontinuitet som finns inbyggd i tvångsvården av barn. För det första ska lagstiftningen tillgodose barns rätt till skydd – även från sina föräldrar. Samtidigt har barn en rätt till sina föräldrar, även om barnet har behövt skiljas från dem av skyddsskäl. Barnets skyddsintresse måste därför balanseras mot intresset av att upprätthålla kontakt med sina biologiska föräldrar under vårdtiden och intresset av att sedan återförenas med dem när vården upphör. Avvägningen mellan nämnda intressen ställs på sin yttersta spets under tvångsvårdens upphörandeskede.

Syftet med denna uppsats är att undersöka och analysera hur intresseavvägningen mellan å ena sidan återförening med de biologiska föräldrarna, och å andra sidan kontinuitet och stabilitet i familjehemmet, ska hanteras vid tvångsvårdens upphörandeskede i svensk rätt. För att uppnå uppsatsens syfte har rättsdogmatisk metod använts för att fastställa gällande rätt, medan rättsanalytisk metod har använts för att analysera rätten utifrån ett barnrättsperspektiv.

Utredningen av gällande rätt visar att intresseavvägningen hanteras genom olika regelkomplex och skilda processer – vårdens upphörande, flyttningsförbud och vårdnadsöverflyttning till familjehemsföräldrar. Utgångspunkten vid vårdens upphörande är att barnet ska återförenas med sina biologiska föräldrar, och det sker därför ingen intresseavvägning mellan återförening och kontinuitet inom ramen för 21 § LVU (lag (1990:52) med särskilda bestämmelser om vård av unga). Om barnet riskerar att skadas till följd av en separation från familjehemmet uppstår emellertid en intressekonflikt mellan återförening och kontinuitet. Denna intressekonflikt hanteras separat inom ramen för institutet flyttningsförbud i 24 § LVU och/eller institutet vårdnadsöverflyttning i 6 kap. 8 § FB (föräldrabalk (1949:381)) – som syftar till att tillgodose barnets behov av kontinuitet i familjehemmet.

I uppsatsen anses såväl uppdelningen, som regelverken i sig, kunna ifrågasättas ur ett barnrättsperspektiv. (Less)
