Motiverat från allmän synpunkt - Ett minskat straffhot vid upphovsrättsliga intrång?

Upphovsrätten är ett rättsområde i ständig förändring. Den svenska upphovsrättslagstiftningen påverkas till stor del av både EU-medlemskapet och internationella konventioner. I september 2020 införde lagstiftaren brottet grovt upp-hovsrättsbrott med en högre straffskala. Samtidigt förändrades åtalsprövningsreglerna till att åklagaren endast ska väcka åtal om det är motiverat från allmän synpunkt. Tidigare regler stadgade att åklagaren skulle väcka åtal om målsägan-den angav brottet till åtal eller att åtalet var påkallat från allmän synpunkt.

I september 2020 införde lagstiftaren brottet grovt upp-hovsrättsbrott med en högre straffskala. Samtidigt förändrades åtalsprövningsreglerna till att åklagaren endast ska väcka åtal om det är motiverat från allmän synpunkt. Tidigare regler stadgade att åklagaren skulle väcka åtal om målsägan-den angav brottet till åtal eller att åtalet var påkallat från allmän synpunkt.

Ett vanligt verktyg för att hindra oönskade beteenden är kriminalisering. Genom kriminalisering förbjuds ett oönskat beteende och det införs sanktioner såsom böter och/eller fängelse. Straffhotet är tänkt att avskräcka från överträdelser, däremot verkar hotet bara avskräckande om man vet att det kommer att realiseras. Frågan som väcktes inför denna undersökning var därmed vad åtalsprövningsreglerna kommer att innebära i praktiken. Det är tänkbart att införandet av grovt upphovsrättsbrott med hårdare straff innebär att det potentiella straffhotet blivit ännu mer effektfullt; å andra sidan kan det likväl tänkas att åtalsprövningsreglerna innebär att straffhotet sällan realiseras.

I undersökningen görs en jämförelse av åtalsprövningsreglerna med andra brott med likvärdiga regler. Slutsatsen blir att åtalsprövningsreglerna gör att straffhotet till viss del minskar, åtminstone för mer ringa fall av upphovsrättsliga intrång. Gemensamt för brott med åtalsprövningsregler är att färre brott går till åtal än för brott som saknar sådana regler. Samtidigt har straffhotet ökat för de mer allvarliga intrången där det finns ett samhälleligt intresse att stävja intrång. Vid de grövre intrången har straffskalan höjts och det är tänkbart att det är motiverat från allmän synpunkt att väcka åtal. (Less)

Copyright is an area of law that is constantly changing. Swedish copyright law is largely affected by both EU membership and international conventions. In September 2020, the legislature introduced the crime of gross copyright infringement with a higher penalty scale. At the same time, the prosecution rules were changed so that the prosecutor will only prosecute if it is justified from a general point of view. Previous rules stipulated that the prosecutor should bring charges if the plaintiff stated the crime to prosecution or that the prosecution was called from a general point of view.

At the same time, the prosecution rules were changed so that the prosecutor will only prosecute if it is justified from a general point of view. Previous rules stipulated that the prosecutor should bring charges if the plaintiff stated the crime to prosecution or that the prosecution was called from a general point of view.

A common tool for preventing unwanted behavior is criminalization. Criminali-zation prohibits unwanted behavior and introduces sanctions such as fines and / or imprisonment. The threat of punishment is intended to deter from violations. However, the threat only acts as a deterrent if it is known that it will be realized. The question that was raised for this investigation was thus what the rules of prosecution will mean in practice. It is conceivable that the introduction of a serious copyright infringement with harsher penalties means that the potential criminal threat has become even more effective; on the other hand, it is nevertheless conceivable that the rules on prosecution mean that the threat of punishment is seldom realized.

The investigation makes a comparison of the prosecution rules with other crimes with equivalent rules. The conclusion is that the rules on prosecution mean that the penalty threat is reduced to a certain extent, at least for minor cases of copyright infringement. Common to crimes with prosecution rules is that fewer crimes are prosecuted than for crimes that do not have such rules. At the same time, the threat of punishment has increased for the more serious trespasses where there is a societal interest in curbing trespasses. In the case of more serious trespasses, the penalty scale has been raised and it is conceivable that it is justified from a general point of view to bring charges. (Less)
