- Arbetstagarskyddet om verksamhetsöverlåtelser regleras i lag (1982:80) om anställningsskydd (LAS) och lag (1976:589) om medbestämmande i arbetslivet (MBL). Den svenska reglerna har inte alltid sett ut som dom gör nu och växt fram ur ljuset av Europeiska unionen (EU) och av Rådets direktiv 2001/23/EG av den 12 mars 2001 om tillnärmning av medlemsstaternas lagstiftning om skydd för arbetstagares rättigheter vid överlåtelser av företag, verksamheter eller delar av företag eller verksamheter. Den svenska reglerna har inte alltid sett ut som dom gör nu och växt fram ur ljuset av Europeiska unionen (EU) och av Rådets direktiv 2001/23/EG av den 12 mars 2001 om tillnärmning av medlemsstaternas lagstiftning om skydd för arbetstagares rättigheter vid överlåtelser av företag, verksamheter eller delar av företag eller verksamheter. Denna uppsatsen redogör med hjälp av en rättsdogmatisk metod för vad arbetstagarskydd är, vad syftet med direktivet är samt en grundläggande presentation av regleringen både på EU-nivå men framförallt i den svenska rätten. Denna uppsats har som övergripande syfte att utreda problematiken som uppstår när flera förvärvare förvärvar olika delar av ett företags verksamhet vid en verksamhetsöverlåtelse och i sin tur mot vilken eller vilka av förvärvarna de olika arbetstagarna har rätt att utöva sina rättigheter hos samt följa med.
Om möjligt ska en arbetstagares anställningsavtal efter att dennes anställningsförhållande inom organisationen bestämts delas upp i flera deltidstjänster hos de berörda förvärvarna. Denna uppdelning ska ske i hänsyn till att en arbetstagare inte ska få försämrade villkor eller anställningsförhållande i relation till hur det såg ut hos överlåtaren innan överlåtelsen. - Swedish law regulates employee protection on business transfers in the Employment Protection Act (1982: 80) or (LAS) and also the Act (1976: 589) on co-determination in working life (MBL). The Swedish rules have not always looked as they do now and have emerged in the light of the European Union (EU) and of Council Directive 2001/23 / EC of 12 March 2001 on the approximation of the laws of the Member States relating to the protection of workers' rights in the event of transfers of companies, businesses or parts of companies or businesses. This essay describes with the help of a legal dogmatic method what employee protection is, what the purpose of the directive is and a basic presentation of the regulation both at EU level but above all in Swedish law. The purpose of this thesis is to investigate the problems that arise when several acquirers acquire different parts of a company's business in the event of a business transfer and in turn to which of the acquirers or which the various employees have the right to exercise their rights with and follow.
If possible, after an employee's employment relationship within the organization has been determined, an employee's employment contract shall be divided into several part - time positions with the acquirers concerned. This division shall take into account that an employee shall not have deteriorating conditions or employment conditions in relation to what it looked like with the transferor before the transfer.
