Abstract
The digital technology has in a short time led to dramatic developments in today's society as the majority of crimes today have taken a new form on social media. The dominant crimes on Facebook and Instagram have mainly shown to be illegal threats,harassment and sexual harassment among young women which only about four percent are solved and while the rest of the reports are dropped. The problem with the low level of clarification of these types of crime is that it has become difficult to access important evidence, which amount to major challenges for the judiciary in dealing with crimes that take place on social media. The digital technology has in a short time led to dramatic developments in today's society as the majority of crimes today have taken a new form on social media. The dominant crimes on Facebook and Instagram have mainly shown to be illegal threats,harassment and sexual harassment among young women which only about four percent are solved and while the rest of the reports are dropped. The problem with the low level of clarification of these types of crime is that it has become difficult to access important evidence, which amount to major challenges for the judiciary in dealing with crimes that take place on social media. In light of the lack of legal treatment and the increasing exposure to these types of crime, the purpose of the study is to examine the challenges posed to the judiciary regarding assessments of illegal threats, harassment and sexual harassment against young women on social media. The approach of the study has been to collect Swedish judgments from courts that deal with the types of crime against young women on social media. Furthermore, the results of the study have shown that the challenges regarding court assessments are largely due to the fact that the Swedish state, as well as the social media platforms, lack control over regulating these types of crimes against young women. The challenges are that the private marketing companies Facebook and Instagram, have the greatest power regarding the technical solutions. Furthermore, this has entailed that Police Investigations only to a small extent have been able to track IP-addresses, which are considered to be of great importance in the matter of whether the investigation can be pursued or not and to further, get a conviction in court. It is therefore considered to be of great importance that the state, together with Facebook and Instagram, cooperate and gain greater control over the platforms than what they have today in order to be able to handle the types of crime that take place on the platforms.
