- Den särskilda utskrivningsprövningen inom den rättspsykiatriska vården har varit omdiskuterad under en längre tid. Flera statliga utredningar har gjorts och en del uppmärksammade fall med lagöverträdare som suttit inom vården uppemot 20 år har skapat en het debatt. Denna uppsats ger en närmare inblick i systemet kring särskild utskrivningsprövning och vilka intressen som är centrala när bedömningar görs.
Allvarligt psykiskt sjuka personer blir som presumtion dömda till rättspsykiatrisk vård istället för fängelse. Vården kan kombineras med eller utan särskild utskrivningsprövning beroende på återfallsrisken för personen att falla in i framtida allvarlig brottslighet.

Samhällsskyddet och återfallsrisken är en framträdande faktor till att personer dels blir dömda till särskild utskrivningsprövning, men också till att personer kan bli fast inom vården utan något egentligt vårdbehov. Jag har studerat hur detta utspelar sig praktiskt genom en redogörelse för gällande rätt, en rad rättsfall och även ett internationellt perspektiv. Kritiken mot samhällsskyddet är framträdande, både nationellt och internationellt vilket jag i analysen kommer att hålla med om. Det är ett område som är i stort behov av en reform och texten har ett kritisk perspektiv som fokuserar mycket på att belysa utvecklingspotentialen för området. (Less) - Abstract

This essay will give a closer look into the system around special discharge review and the central interests when assessments are done.
People who are mentally ill will as a presumtion get convicted to forensic psychiatry instead of jail. The treatment can be combined with or without special discharge review depending on the risk of relapse into future crime.
The civil protection and risk of relapse into future crime is a prominent... A couple of state investigations have been made and several high-profile cases with offenders who have been within the psyciatric care upwards 20 years have created a great debate. This essay will give a closer look into the system around special discharge review and the central interests when assessments are done.
People who are mentally ill will as a presumtion get convicted to forensic psychiatry instead of jail. The treatment can be combined with or without special discharge review depending on the risk of relapse into future crime.
The civil protection and risk of relapse into future crime is a prominent factor to people being convicted to special discharge review, but also that these persons can get stuck within the care without any care needs. I’ve studied how this outplays practically through an account of current law and an international perspective. The criticism against civil protection is prominent, both nationally and internationally which I will agree with in my analysis. The area is in a great need of reform and the essay will have a critical perspective which will focus on illustrating the development potential of the subject. (Less)
