Abstract
The Council on Legislation (Lagrådet) is a key institution in the Swedish
democratic process whose role is to examine proposed legislation. This thesis seeks
to combine legal and political literature in order to explain under what conditions
governments chose to adhere to, or not adhere to, their critique.
The study was conducted as a quantitative analysis of significantly criticized
bills proposed by four Swedish governments from 2002 to 2018. Criticized bills
were identified by a keyword identification program followed by an in depth
reading and coding of the critique lifted. The proposals were subsequently

democratic process whose role is to examine proposed legislation. This thesis seeks

governments chose to adhere to, or not adhere to, their critique.
The study was conducted as a quantitative analysis of significantly criticized
bills proposed by four Swedish governments from 2002 to 2018. Criticized bills
were identified by a keyword identification program followed by an in depth
reading and coding of the critique lifted. The proposals were subsequently
categorized according to policy area. Thereafter an analysis was conducted on how
differences in critique and policy area affected governments degree of adherence.
The study found 3 key results. 1) The number of heavily criticized bills has
increased substantially in the past decade while the degree of adherence to this
critique has decreased. 2) Criticism concerning a bill's capability to reach its
objective is frequently disregarded. 3) Governments tend to adhere to criticism in
policy areas such as economic regulation and incorporation of EU-law while the
Council on Legislation's opinion is often overlooked in areas such as criminal law,
migration, and civil rights.
The results are interpreted as a sign that judicial expertise in the policy process
is limited by symbolic interests and that expert knowledge seldom can influence
policy areas with high moral values. The cause of the increase in criticized
legislation remained inconclusive. (Less)
