Sexualbrottsmål där barn är målsägande hanteras i viss mån annorlunda än sexualbrottsmål där målsägande är vuxen. Bland annat görs avsteg från vissa processuella principer till förmån för barnets hälsa men även andra faktorer inverkar på hur domstolen hanterar den bevisning som presenteras. Eftersom rätten består av människor har också subjektiva uppfattningar alltid inflytande på bevisvärderingen, hur objektiv domstolen än försöker hålla sig. Samtidigt som sexualbrott mot barn, enligt ovan, hanteras annorlunda, ställs samma beviskrav upp oavsett vem som är målsägande. Eftersom rätten består av människor har också subjektiva uppfattningar alltid inflytande på bevisvärderingen, hur objektiv domstolen än försöker hålla sig. Samtidigt som sexualbrott mot barn, enligt ovan, hanteras annorlunda, ställs samma beviskrav upp oavsett vem som är målsägande. Bevisningen består ofta av målsägandens utsaga vilken ställs mot den tilltalades. Uppsatsen har sin utgångspunkt i bevisvärderingen av barnets utsaga och är särskilt inriktad på frågan om vad som krävs för att uppnå kravet på en tillförlitlig utsaga samt vilken betydelse stödbevisningen har i dessa mål.

Med hjälp av rättsdogmatisk metod undersöks kravet på tillförlitlighet i målsägandeutsagor i sexualbrottsmål och vilka faktorer som påverkar ett barns möjligheter att uppnå detta krav gentemot en vuxen tilltalad. Den utredande delen lyfter fram de rättspsykologiska aspekterna av domstolens bevisvärderande verksamhet, presentationsformens betydelse för hur barnets utsaga bedöms samt stödbevisningens alltmer avgörande betydelse.

I analysen konstateras att barnet redan initialt hamnar i ett underläge, jämfört med den vuxna. Detta beror inte på att barnet är mindre tillförlitlig som vittne, utan snarare på faktorer omkring vittnesmålet som gör att domstolen värderar barnets utsaga med större försiktighet. Försiktigheten leder till att domstolen ofta finner barnets utsaga mer bristfällig och därför blir behovet av stödbevisning ännu viktigare. Vilken typ av stödbevisning som krävs tycks spela mindre roll, det väsentliga är förekomsten eller frånvaron av sådan bevisning. (Less)

Cases of sexual abuse are in some aspects conducted differently in the judicial system when the plaintiff is a child, compared to the same type of crimes against an adult. Some procedural principles are put aside in favor of the mental health of the child and other factors affect the manner in which the evidence is treated. Furthermore, as the court consists of people, the subjective brain will always have some influence over the way the court values the evidence – no matter how objective the court attempts to be. Concurrently, the evidentiary requirement is the same regardless of who the victim of the offence is, and the evidence often primarily consists of the testimony of the plaintiff against the defendants. Some procedural principles are put aside in favor of the mental health of the child and other factors affect the manner in which the evidence is treated. Furthermore, as the court consists of people, the subjective brain will always have some influence over the way the court values the evidence – no matter how objective the court attempts to be. Concurrently, the evidentiary requirement is the same regardless of who the victim of the offence is, and the evidence often primarily consists of the testimony of the plaintiff against the defendants. The outset of this paper is the evaluation of evidence in cases of this sort and is focused on the question of what is required for a child to achieve a reliable testimony, and what role supporting evidence plays in relation to this.

Through legal dogmatic method, the thesis examines the requirement of reliability in the statement of the appellant in cases of sexual abuse and what factors affects the possibilities for children to achieve this prerequisite against an adult defendant. The investigative part emphasises the psychological aspects of the courts evaluative process, the consequences of the way the evidence is being presented before the court and the increasingly important role of the supporting evidence.

The result shows that it is more difficult for a child than for an adult to reach the required level of reliability in their statement. This does not depend on the child being less reliable as a witness, but on factors surrounding the statement that brings the court to evaluate the child’s statement with more caution. As a consequence of the carefulness, the court is more likely to find inadequacies in the child’s statement, hence the need for supporting evidence is more vital. What type of supporting evidence is needed appears to matter less, the important thing is the existence or absence of such evidence. (Less)
