En dansk kriminalisering av psykiskt våld i Sverige? En komparativ studie av kriminalisering av psykiskt våld i Sverige och Danmark

Frågan om en kriminalisering av psykiskt våld har aktualiserats i flera lagstiftningsprocesser i Sverige. Någon kriminalisering har däremot inte kommit till stånd. I Danmark infördes emellertid år 2019 en ny bestämmelse i straffeloven som reglerar psykiskt våld i nära relationer. I uppsatsen undersöks svenska regeringens respektive danska Justitieministeriets argument som har aktualiserats beträffande en kriminalisering av psykiskt våld. I Danmark infördes emellertid år 2019 en ny bestämmelse i straffeloven som reglerar psykiskt våld i nära relationer. I uppsatsen undersöks svenska regeringens respektive danska Justitieministeriets argument som har aktualiserats beträffande en kriminalisering av psykiskt våld. Uppsatsen syftar till att undersöka skiljelinjerna länderna emellan avseende skäl för eller emot en kriminalisering av psykiskt våld samt till att undersöka huruvida skälen bakom den danska kriminaliseringsmodellen kan ha relevans för svensk rätts vidkommande. För att uppfylla syftet för uppsatsen genomförs således en komparativ argumentationsanalys. Analysen utgår ifrån teoretiska utgångspunkter för när och hur kriminalisering ska brukas. Argumenten som analyseras härrör från relevanta förarbeten där frågan har aktualiserats.

Den svenska regeringen har i de undersökta lagstiftningsprocesserna framfört flera argument till nackdel för en kriminalisering av psykiskt våld. I huvudsak har argumenten kunnat kopplas till principen om ultima ratio, legalitetsprincipen samt överväganden om allmänprevention. Särskilt tongivande har resonemanget som anknyter till ultima ratio varit. För danska Justitieministeriets vidkommande har resonemangen till förmån för en kriminalisering av psykiskt våld kunnat kopplas till den symbolfunktion en kriminalisering kan ha. Den största skillnaden länderna emellan kan således vara hänförbar till huruvida kriminalisering ska användas som medel mot psykiskt våld. Där svenska regeringen bland annat argumenterar ur ett ultima ratio-perspektiv syns Justitieministeriets strävan efter att signalera det psykiska våldets klandervärdhet med hjälp av straffrätten. I relation till det och uppsatsens teoretiska utgångspunkter kan det tänkas vara svårt att med endast symbolfunktionella skäl motivera en kriminalisering för svenskt vidkommande. Skälen bakom den danska kriminaliseringen kan således anses ha begränsad relevans för svensk rätts vidkommande utifrån uppsatsens givna ramar. (Less)

The matter of criminalizing psychological violence has been under discussion in various legislative processes in Sweden. To this day, the Swedish legislator has yet to criminalize psychological violence. In 2019, Denmark however adopted a new penal code that regulates psychological violence. This bachelor’s thesis examines the different aspects of a criminalization of psychological violence that have been addressed by the Swedish and Danish governments. This bachelor’s thesis examines the different aspects of a criminalization of psychological violence that have been addressed by the Swedish and Danish governments. The purpose of the thesis is to analyse the different standpoints between the two countries in terms of whether psychological violence should be criminalized. Furthermore, the thesis aims to examine whether the motives behind the Danish criminalization of psychological violence could be indicative for Swedish purposes. Thus, the thesis conducts a comparative analysis of the arguments presented by both governments. Furthermore, the analysis is conducted on the basis of a legal theory regarding criminalization. The arguments that have been analysed derive from documents of legislative history.

The examined legislative processes show that the Swedish government has presented various arguments against a criminalization of psychological violence. There is a correlation between the arguments and the principle of ultima ratio, the principle of legality and issues of general prevention. The argument correlating with the principle of ultima ratio has been particularly influential. Regarding the Danish government, the examination shows that the presented arguments correlate with the symbolic functions that a criminalization can entail. The main difference between the two countries is the view on whether criminalization is an appropriate means against psychological violence. Considering the aforementioned difference and the theoretical approach to the thesis, it may be difficult to argue in favour of a merely symbolic criminalization of psychological violence in Sweden. The motives behind the Danish criminalization can therefore not be considered as indicative for Swedish purposes. (Less)
