Det här arbetet tar sikte på två saker. Dels att förklara vad den grundlagsskyddade rätten till mötesfrihet innebär, och dels att utforska hur denna rättighet kan komma att begränsas med den nya lagstiftning som införts i Sverige med anledning av covid-19-pandemin. Texten förklarar vad mötesfriheten är, hur och när den kan begränsas, vilka andra lagar som relaterar till mötesfriheten och hur den nya tillfälliga covid-lagen kan komma att användas. Det görs också en lång redogörelse för regeringens resonemang bakom den nya lagen, med tillhörande kritik och synpunkter.
Abstract
This text aims to do primarily two things. One – to explain what the constitutionally protected freedom of assembly entails in a Swedish context, and two - to explore how restrictions can be placed on this freedom by means of the new law that has been enacted in Sweden due to the covid-19-pandemic. We will explain what freedom of assembly means, how and when it can be curtailed, what other laws relate to the freedom of assembly and how the new temporary covid-law might be used. There will also be a lengthy presentation of the Swedish governments reasoning behind the new law, with accompanying critique and considerations.
