- I budgetpropositionen 2016 konstaterade regeringen att det fanns en förhöjd risk på konsumentkreditmarknaden för att konsumenter att hamna i överskuldsättning. En rad åtgärder föreslog varav en av dem innebar införskaffandet av ett måttfullhetskrav vid marknadsföring av konsumentkrediter. Kravet på måttfullhet har existerat i svensk rätt sedan det först omnämndes i 1992 års proposition till marknadsföringslagen. I uppsatsen belyses två domar varav den ena har meddelats innan reformen och den andra efter.
Syftet med uppsatsen är att utreda den historiska bakgrunden till måttfullhetskravet som introducerades 2018. Vidare kommer utredningen utifrån de två rättsfallen studera om måttfullhetskravet inneburit någon förändring av rättsläget och dessutom om konsumentskyddet har stärkts.
Uppsatsen konstaterar att reformen inte bidragit till en strängare bedömning av måttfullhetskravet men att avsaknaden av transaktionstestet har bidragit till ett starkare konsumentskydd. (Less) - Abstract

The purpose of this paper is to investigate the historical bakground for the abstentionrequirment that was introduced in 2018. The two court findings are used to study if the requirement had any ramifacations on the current legal status and also if consumer protection has been strenghtend.
The conclusion of this paper is that the abstentionrequirment has not been made stricter after the reform but the abolishment of the transactiontest has increased consumer protection on the consumer credit market. (Less)
