Förevarande uppsats ämnar till att granska gränserna för när företag på videospelsmarknaden får vidta geoblockerande åtgärder. Fokus ligger på förbudet mot konkurrensbegränsande avtal enligt artikel 101 FEUF samt tillämpningsområdet för artikel 4.1.b i geoblockeringsförordningen. Uppsatsen syftar till att dels kartlägga vad som utgör gällande rätt avseende geoblockerande åtgärder, dels att utreda om rådande tillämpningsområde för artikel 4.1.b i geoblockeringsförordnigen bör utvidgas.

Förevarande uppsats ämnar till att granska gränserna för när företag på videospelsmarknaden får vidta geoblockerande åtgärder. Fokus ligger på förbudet mot konkurrensbegränsande avtal enligt artikel 101 FEUF samt tillämpningsområdet för artikel 4.1.b i geoblockeringsförordningen. Uppsatsen syftar till att dels kartlägga vad som utgör gällande rätt avseende geoblockerande åtgärder, dels att utreda om rådande tillämpningsområde för artikel 4.1.b i geoblockeringsförordnigen bör utvidgas.

Genom användandet av en kartläggande rättsdogmatisk och en EU-rättslig metod når denna uppsats slutsatsen att exklusiva och territoriellt avgränsade licensavtal på videospelsmarknaden är tillåtna enligt artikel 101 FEUF. Den territoriella avgränsningen får dock inte säkerställas genom förpliktelser som medför en absolut territoriell ensamrätt. Innebörden är att tillåtna territoriellt avgränsade licensavtal exempelvis inte får inkludera ett förbud mot passiv försäljning för att säkerställa att gränserna för det territoriellt avgränsade licensavtalet upprätthålls. Något motsvarande förbud för ensidigt utförda geoblockerande åtgärder förekommer inte för företag på videospelsmarknaden som inte har en dominerande ställning på marknaden. Detta beror på att artikel 4.1.b i geoblockeringsförordningen undantar onlinetjänster som primärt tillhandahåller upphovsrättskyddade verk från ett sådant förbud.

Den senare delen av framställningens syfte besvaras genom nyttjandet av en kritisk rättsdogmatisk metod. Trots att EU-kommissionen utreder en eventuell utvidgning av tillämpningsområdet för artikel 4.1.b i geoblockeringsförordningen återfinns enbart en begränsad juridisk diskurs, något som denna uppsats problematiserar. Resultatet av denna avslutande del är att en utvidgning av tillämpningsområdet vore motiverat för att bland annat säkerställa en fungerande inre marknad. (Less)

The present essay intends to examine in which degree companies in the video game market are allowed to take measures of geo-blocking. The focus lays on the prohibition of anti-competitive agreements according to Article 101 TFEU and the scope of Article 4.1.b of the Geo-blocking Regulation. This essay aims to conclude what constitutes applicable law regarding geo-blocking measures, and to investigate whether the current scope of application of Article 4.1.b of the Geo-blocking Regulation should be extended.

While using a mapping legal dogmatic method as well as an EU legal method this essay concludes that exclusive and territorially exclusivity licensing agreements in the video game market are permitted according to Article 101 TFEU.... (More)

This essay aims to conclude what constitutes applicable law regarding geo-blocking measures, and to investigate whether the current scope of application of Article 4.1.b of the Geo-blocking Regulation should be extended.

While using a mapping legal dogmatic method as well as an EU legal method this essay concludes that exclusive and territorially exclusivity licensing agreements in the video game market are permitted according to Article 101 TFEU. However, the territorial exclusivity may not be ensured by obligations that establish an absolute territorial exclusivity. This means that permitted territorial exclusivity license agreements, for example, are not allowed to include a ban on passive sales to ensure that the boundaries of territorially exclusivity are maintained. There is no corresponding ban on unilaterally implemented geo-blocking measures for companies in the video game market that do not hold a dominant market position. This is because Article 4.1.b of the Geo-blocking Regulation excludes online services that primarily provide copyright protected works from such ban.

The latter part of the purpose of this essay is answered through the use of a critical legal dogmatic method. Although the European Commission is investigating a possible extension of the scope of Article 4.1.b of the Geo-blocking Regulation, there is only a limited legal discourse on the subject, a situation that this essay illuminate. The result of this latter part is that an extension of the scope would be justified to, among other things, ensure the functioning of the internal market. (Less)
