Digitala nödtestamenten – en förglömd rättighet? En komparativ studie av möjligheten att upprätta digitala nödtestamenten

- I ett rättsfall från 2013 aktualiseras en situation där ett digitalt upprättat nödfallstestamente inte ansågs uppfylla de formkrav som anges i ÄB. Syftet med denna rättsvetenskapliga uppsats är att därför påvisa varför digitalt upprättade testamenten omöjligen kan legitimeras enligt nuvarande lagstiftning i Sverige. I kontrast till det svenska rättsväsendet accepteras digitalt upprättade nödtestamenten i Danmark. I besvarandet av huvudfrågan görs således en komparativ studie med dansk testamentsrätt för att bättre illustrera problematiken med den svenska de nu gällande formkraven. Historiska aspekter nämns också i denna rättsvetenskapliga uppsats i syfte att förklara de nuvarande bestämmelsernas utformning.

För att kunna undersöka uppsatsens huvudfråga kombineras omfattande litteraturstudier med utdrag ur rättspraxis och förarbeten. Resultatet av studien visar att digitalt upprättade nödtestamenten inte kan legitimeras i svensk rätt eftersom sådana omöjligen uppfyller dagens krav på närvaron av solennitetsvittnen eller existensen av en underskrift. I Danmark godtas digitala nödtestamenten eftersom lagrummet ej ställer upp några formkrav. Rättssystemen skiljer sig därför åt genom att svensk rätt låter formkraven styra nödtestamentets legitimitet, medan dansk rätt innehar ett större fokus på testatorsviljan. (Less) - Abstract

The purpose of this work is therefore to demonstrate why digitally drawn emergency wills can not be legitimized under current Swedish legislation. In contrast to the Swedish legal system, digitally drawn emergency wills are accepted in Denmark. Extensive literature studies are combined with extracts from case law and legal preparatory work, in order to answer the main question of this paper. The results of the study show that digitally drawn emergency wills cannot be legitimized according to Swedish law because they impossibly meet today's requirements for the presence of solemnity witnesses or the existence of a signature. In Denmark however, digital emergency wills are accepted because the law does not set any formal requirements at all. The legal systems therefore differ in that Swedish law allows the formal requirements to govern the legitimacy of the emergency will, while Danish law has a greater focus on the testator's will per se.
