- Första gången lagstiftaren på allvar lyfte diskussionen om mäns våld mot kvinnor i nära relationer var på 90-talet. Efter den omfattande utredningen Kvinnofrid infördes ett nytt brott, grov kvinnofridskränkning, som en av flera åtgärder för att motverka våldet. Våldet har trots det fortsatt, och utsatta kvinnor vittnar om att psykiskt våld är det som är svårast att hantera. Uppsatsen ämnar undersöka huruvida grov kvinnofridskränkning omfattar psykiskt våld utifrån HD:s praxis, samt om juridiken är i fas med gällande forskningsläge om mäns psykiska våld mot kvinnor.

Ytterst lite av den kunskap som finns på området visar sig ha implementerats i juridiken, och HD tar begränsad hänsyn i sin bedömning till den psykologiska, på längre sikt nedbrytande process kvinnorna utsätts för. Syftet med införandet av grov kvinnofridskränkning var att möjliggöra en helhetsbedömning av kvinnans utsatta situation genom att ta sikte på själva upprepandet av kränkningar. Uppsatsen drar slutsatsen att det går att ifrågasätta om syftet verkligen efterlevs om inte den psykiska aspekten beaktas.
Våld i nära relationer existerar sällan från början, utan ökar successivt i intensitet och frekvens. Ju längre det fortsätter, desto svårare blir det att hejda. Samtliga av uppsatsen undersökta aktörer belyser vikten av att stoppa processen av våld i nära relationer i ett tidigt skede. Uppsatsen kommer fram till att psykiskt våld behöver omfattas i en större utsträckning för att detta ska vara möjligt. (Less) - Abstract

After an extensive investigation by the Swedish Government, a new crime, gross violence of a woman’s integrity, was introduced as one of several measures to counteract the violence. - The first time the legislature seriously raised the issue of men’s violence against women in close relationships was in the 1990s. After an extensive investigation by the Swedish Government, a new crime, gross violence of a woman’s integrity, was introduced as one of several measures to counteract the violence. Despite the new crime, the violence has not stopped, and women who have been victims of the violence testify that the psychological violence is the most difficult to suffer. This essay intends to investigate whether gross violence of a woman’s integrity include psychological violence based on the Supreme Court’s practice, and whether the law is up to date with modern research on men’s psychological violence against women in close relationships.
Not much of the research on the field turns out to have been implemented in law, and the Supreme Court takes little into account the psychological and destructive process the women are exposed to. The purpose behind the introduction of the crime was to enable an overall assessment of the woman’s vulnerable situation by focusing on the repetition of violations. The essay concludes that it is possible to question whether the purpose is fulfilled if the psychological aspect is not taken into account.
Violence in close relationships rarely exists from the beginning, instead it gradually increases in both intensity and frequency. The longer it is allowed to continue, the more difficult it becomes to stop. All parties examined by the essay emphasize the importance of ending the process of violence in close relationships at an early stage. The essay concludes that psychological violence needs to be considered to a greater extent for this to be possible. (Less)
