Uteslutning och suspension är två av de hårdaste sanktionerna som en internationell organisation kan tillämpa på en av sina egna medlemsstater. Dessa sanktioner är vanligtvis förbehållna allvarliga överträdelser av organisationens grundläggande normer. Dessvärre är normer av det här slaget är ofta vagt formulerade. Dessutom kan en uteslutning eller suspension medföra för organisationen oönskade politiska konsekvenser. Detta kan undergräva sanktionernas förmåga att avskräcka organisationens medlemsstater från överträdelser av de grundläggande normerna.

Uteslutning och suspension är två av de hårdaste sanktionerna som en internationell organisation kan tillämpa på en av sina egna medlemsstater. Dessa sanktioner är vanligtvis förbehållna allvarliga överträdelser av organisationens grundläggande normer. Dessvärre är normer av det här slaget är ofta vagt formulerade. Dessutom kan en uteslutning eller suspension medföra för organisationen oönskade politiska konsekvenser. Detta kan undergräva sanktionernas förmåga att avskräcka organisationens medlemsstater från överträdelser av de grundläggande normerna.

Den här uppsatsen syftar till undersöka hur reglerna för tillämpning av uteslutning och suspension i förhållande till en organisations grundläggande normer kan utformas på ett ändamålsenligt sätt. Uppsatsen undersöker tre internationella organisationer: Förenta nationerna, Europarådet och Europeiska unionen. Resultatet av dessa undersökningar ligger sedan till grund för en komparativ analys med målet att identifiera styrkor och svagheter i de undersökta regelverken. Uppsatsen avslutas med förslag på hur dessa regelverk kan förbättras. (Less)

Expulsion and suspension are two of the toughest sanctions which an international organisation can apply to one of its own member states. These sanctions are usually reserved for serious violations of the organisation’s fundamental norms. Unfortunately, norms of this nature are often vaguely defined. Expulsion or suspension can also bring about undesired political consequences for the organisation. This can undermine the ability of the sanctions to deter the organisation’s member states from violating the fundamental norms.

Expulsion or suspension can also bring about undesired political consequences for the organisation. This can undermine the ability of the sanctions to deter the organisation’s member states from violating the fundamental norms.

The purpose of this essay is to examine how rules regarding expulsion and suspension in relation to fundamental norms should be devised in order to achieve their goals. The essay examines three international organisations: the United Nations, the Council of Europe and the European Union. The findings from these examinations are analysed with the aim of identifying strengths and weaknesses in the rules of the studied organisations. The essay concludes with recommendations for how these rules can be improved. (Less)
