Det föreligger ett samhälleligt behov av en effektiv brottsbekämpning till skydd för samhällsmedborgarna. Effektiv brottsbekämpning upprätthålls genom de brottsbekämpande myndigheterna som har diverse möjligheter att bedriva verksamheten på. En av möjligheterna är användningen av hemliga tvångsmedel. Hemliga tvångsmedel är åtgärder som innebär att en misstänkt person övervakas eller avlyssnas, utan att samtycke föreligger. Det är emellertid inte bara den misstänkte personen som riskerar att bli föremål för övervakning eller avlyssning, utan också andra utomstående, det vill säga tredje man, som kommer i kontakt med den misstänkte personen. Det föreligger ett samhälleligt behov av en effektiv brottsbekämpning till skydd för samhällsmedborgarna. Effektiv brottsbekämpning upprätthålls genom de brottsbekämpande myndigheterna som har diverse möjligheter att bedriva verksamheten på. En av möjligheterna är användningen av hemliga tvångsmedel. Hemliga tvångsmedel är åtgärder som innebär att en misstänkt person övervakas eller avlyssnas, utan att samtycke föreligger. Det är emellertid inte bara den misstänkte personen som riskerar att bli föremål för övervakning eller avlyssning, utan också andra utomstående, det vill säga tredje man, som kommer i kontakt med den misstänkte personen. Följden av användningen av hemliga tvångsmedel är att det utgör ett intrång i den personliga integriteten, vilket är ett motstående intresse till intresset av effektiv brottsbekämpning.
Vid lagstiftning om och användning av hemliga tvångsmedel måste särskilda principer uppfyllas för att åtgärderna ska aktualiseras. Principerna är legalitetsprincipen som gäller generellt för straff- och straffprocessrätten, ändamålsprincipen, behovsprincipen och proportionalitetsprincipen. Principerna, särskilt den sistnämnda, genomsyrar den intresseavvägning mellan effektiv brottsbekämpning och personlig integritet som måste göras. Intresseavvägningen omfattar nyttan och behovet av hemliga tvångsmedel i relation till det integritetsintrång som användningen av hemliga tvångsmedel har medfört och kan komma att medföra om de nya åtgärderna genomförs.
På senare år, särskilt under 2000-talet, har lagstiftningen och den allmänna debatten varit intensiv på området. Samhällets ständiga utveckling, framför- allt i teknologiskt och internationaliserad riktning, föranleder diskussion om användning av hemliga tvångsmedel, genomförande av nya möjligheter till hemliga tvångsmedel och om diverse möjligheter är proportionerliga med anledning av intresset av personlig integritet.
Det senaste initiativet till genomförande av nya möjligheter till hemliga tvångsmedel, som för närvarande är under utredning, är uppdraget enligt regeringens 34-punktsprogram mot gängkriminalitet. Uppsatsen har haft som syfte att analysera utredningspunkten om möjligheten att använda hemlig avlyssning av elektronisk kommunikation, hemlig kameraövervakning och hemlig rumsavlyssning vid misstanke om flera brott vars samlade straffvärde kan antas överstiga ett visst straff och besvara frågan om utredningspunkten uppfyller de rättsliga kraven om proportionalitet. Som en del av en tvådelad analys har uppsatsen därutöver haft som syfte att analysera hur utrednings- punkten såväl lagförslaget sammantaget bör bedömas enligt en utvidgad proportionalitetsbedömning där senare års lagstiftning och andra möjliga faktorer beaktas utifrån ett helhetsperspektiv.
Uppsatsens slutsats är att utredningspunkten inte är proportionerlig med tanke på det förväntade integritetsintrång som möjligheten kan tänkas medföra. Trots att utredningspunkten inte uppfyller de rättsliga kraven om proportionalitet hävdar jag att både utredningspunkten och lagförslaget sammantaget bör bedömas enligt en utvidgad proportionalitetsbedömning där senare års lagstiftning och andra möjliga faktorer beaktas. Slutsatsen att utredningspunkten inte är proportionerlig kvarstår om utredningspunkten bedöms enligt en utvidgad proportionalitetsbedömning. (Less)

There is a societal need for effective law enforcement to protect citizens. Effective law enforcement is maintained through the law enforcement authorities, which have various opportunities to conduct business. One of the possibilities is the use of secret coercive measures. Secret coercive measures are measures that involve a suspect being monitored or intercepted without consent. However, it is not only the suspect who is at risk of being monitored or intercepted, but also other outsiders, i.e. third parties, who come into contact with the suspect. Effective law enforcement is maintained through the law enforcement authorities, which have various opportunities to conduct business. One of the possibilities is the use of secret coercive measures. Secret coercive measures are measures that involve a suspect being monitored or intercepted without consent. However, it is not only the suspect who is at risk of being monitored or intercepted, but also other outsiders, i.e. third parties, who come into contact with the suspect. The consequence of the use of secret coercive measures is that it constitutes an infringement of personal integrity, which is a conflicting interest with the interest of effective law enforcement.
When legislating for and using secret coercive measures, special principles must be met in order for the measures to be used. The principles are the principle of legality that applies in general to criminal and criminal procedure law and the principles of purposefulness, necessity and proportionality. The principles, especially the latter, permeate the balance of interests between effective law enforcement and personal integrity that must be applied. The balance of interests includes the benefit and need for secret coercive measures in relation to the invasion of personal integrity that the use of the measures has entailed and may entail if the new measures are implemented.
In recent years, especially in the 21st century, legislation and the general debate have been intense in this area. The constant development of society, especially in a technological and internationalized direction, gives rise to discussion about the use of secret coercive measures, the implementation of new possibilities for said measures and whether various possibilities are proportionate due to the interest of personal integrity.
The latest initiative to implement new opportunities for secret coercive measures, which is currently under investigation, is the assignment according to the Government's 34-point programme against gang crime. The purpose of the thesis has been to analyze investigation point about the possibility of using secret interception of electronic communication, secret camera surveillance and bugging in case of suspicion of several crimes whose total penal value can be assumed to exceed a certain punishment, and whether the investigation point meets the legal requirements of proportionality. As part of a two-part analysis, the thesis has also aimed to analyze how the investigation point as well as the bill as a whole should be assessed according to an expanded proportionality assessment where recent years' legislation and other possible factors are considered from a holistic perspective.
The thesis' conclusion is that the investigation point is not proportionate in view of the expected invasion of personal integrity that the proposed possibility may entail. Despite the fact that the investigation point does not meet the legal requirements for proportionality, I argue that both the investigation point and the bill together should be assessed according to an extended assessment of proportionality, where recent years' legislation and other possible factors are taken into account. The conclusion remains although the investigation point is assessed according to an extended proportionality assessment. (Less)
