Straffvärdeventil för flerfaldig brottslighet - ett rättssäkert sätt att utöka tillämpningsområdet för hemliga tvångsmedel?

Regeringen lade under hösten 2020 fram ett förslag om att utöka tillämpningsområdet för hemliga tvångsmedel genom att införa en straffvärdeventil som tar sikte på flerfaldig brottslighet. Förslaget motiveras mot bakgrund av att de brottsutredande myndigheterna är i behov av effektiva utredningsåtgärder för att kunna utreda mindre allvarliga brott som sker på ett systematiskt sätt. Införandet av en sådan mekanism kan således komma att ske i syfte att främja det brottsbekämpande intresset under förundersökningen på bekostnad av enskildas intresse av skydd mot intrång i den personliga integriteten.

Regeringen lade under hösten 2020 fram ett förslag om att utöka tillämpningsområdet för hemliga tvångsmedel genom att införa en straffvärdeventil som tar sikte på flerfaldig brottslighet. Förslaget motiveras mot bakgrund av att de brottsutredande myndigheterna är i behov av effektiva utredningsåtgärder för att kunna utreda mindre allvarliga brott som sker på ett systematiskt sätt. Införandet av en sådan mekanism kan således komma att ske i syfte att främja det brottsbekämpande intresset under förundersökningen på bekostnad av enskildas intresse av skydd mot intrång i den personliga integriteten.

Utifrån motsättningen mellan statens intresse av en effektiv brottsbekämpning och den enskildes intresse av skydd mot intrång i den personliga integriteten har denna uppsats granskat hur hemliga tvångsmedel får användas under en förundersökning. Genom att använda Herbert Packers typmodeller av straffprocessen, rättssäkerhetsmodellen och brottsbekämpningsmodellen, som ett analysverktyg har regleringen för hemliga tvångsmedel analyserats. Slutsatsen är att regleringen är utformad på ett sätt som prioriterar intresset av den enskildes rätt till skydd mot intrång i den personliga integriteten. Emellertid kan det påpekas att de senaste lagändringarna på området visar på ett ökat intresse av en effektiv brottsbekämpning

Vidare har uppsatsen syftat till att undersöka hur införandet av en straffvärdeventil som tar sikte på flerfaldig brottslighet skulle kunna påverka den brottsbekämpande verksamheten under en förundersökning i relation till individens krav på rättssäkerhet. I arbetet med denna uppsats har därför begreppen rättssäkerhet och effektiv brottsbekämpning undersökts. De regler som styr straffvärdebedömningen för flerfaldig brottslighet har även behandlats.

Den slutsats som uppsatsen kommer fram till är att införandet av en straffvärdeventil som tar sikte på flerfaldig brottslighet på ett tydligt sätt hade gynnat den brottsbekämpande verksamheten under en förundersökning. Emellertid konstateras det att det framstår som tämligen komplicerat att under en förundersökning göra en korrekt bedömning av flerfaldig brottslighets straffvärde. Då det rör sig om statlig tvångsutövning mot enskild talar högt ställa krav på rättssäkerhet för att en straffvärdeventil som tar sikte på flerfaldig brottslighet bör undvikas. (Less)
Abstract
During the autumn of 2020 the Swedish government presented a proposal to extend the area of application for the use of secret coercive measures through the introduction of a ‘penal value valve’ that targets multiple crimes. The proposal is justified by the law enforcement authorities need for effective measures of investigation in order to investigate crimes of minor severity committed in a systematical manner. The introduction of such a mechanism would be to foster the interest of crime control during the preliminary investigation at the expense of the individual’s interest of protection against invasion of privacy.

The proposal is justified by the law enforcement authorities need for effective measures of investigation in order to investigate crimes of minor severity committed in a systematical manner. The introduction of such a mechanism would be to foster the interest of crime control during the preliminary investigation at the expense of the individual’s interest of protection against invasion of privacy.

Based on the contradiction between the states interest of an effective crime control and the individual’s interest in protection against invasion of privacy this essay has examined how secret coercive measures can be used during a preliminary investigation. Through the use of Herbert Packers models of the criminal procedure, the Due Process model and the Crime Control Model, the regulation regarding secret coercive measures has been analyzed. The conclusion is that the regulation is designed in a way that prioritizes the interest of the individual’s right to protection against invasion of privacy. However, it can be pointed out that the latest amendments relating to the area of secret coercive measures indicate an increased interest of an effective crime control.

Furthermore, this essay has aimed to examine how the introduction of a ‘penal value valve’ that targets multiple crimes could affect the crime control during a preliminary investigation in relation to the individuals demand for legal security. The essay has therefore examined the concept of legal security and crime control. The rules for assessing the penal value of multiple crimes has also been processed.

The conclusion that is presented in this essay is that the introduction of a ‘penal value valve’ that targets multiple crime would clearly benefit the crime control function of the preliminary investigation. However, the essay establish that it appears to be fairly difficult to correctly assess the penal value of multiple crimes during a preliminary investigation. As the regulation regards the use of coercive measures sanctioned by the state, high demands for legal security argues that a ‘penal value valve’ that targets multiple crimes should be avoided.
