AI: A problem or a solution? - A critical analysis of the current formulation of the problem-solution approach in an AI context

- This thesis concerns the potential impact of AI on the patent system in Europe, the EPC, both from the perspective of the developers of AI and AI-assisted inventions, but mainly from the perspective of the EPO concerning whether the current patent system is sufficiently equipped to assess, in particular, whether a claimed invention involves an inventive step. The purpose of the thesis is to investigate whether there is a need to adjust the EPC to handle an influx of AI-assisted inventions under the current system and if the problem-solution method is flexible enough to withstand challenges posed by the utilization of AI in the assessment process.

The purpose of the thesis is to investigate whether there is a need to adjust the EPC to handle an influx of AI-assisted inventions under the current system and if the problem-solution method is flexible enough to withstand challenges posed by the utilization of AI in the assessment process.
Through an analysis of forward looking literature on the topic, its is clear that inventors can utilize AI and ML to screen the prior art in search for new inventive opportunities. The EPO can utilize AI and ML to streamline the patentability assessment structure and more accurately gauge whether an invention truly is inventive or just an obvious continuation of prior art. The concept contained in the problem-solution that could potentially face alterations due to the integration of AI and ML in the assessment process for patentability is mainly the concept of the person skilled in the art. This hypothetical person can be attributed abilities and knowledge in order to assess whether the solution to a technical problem, provided by a claimed invention, was obvious. However, as AI does not inherently possess any knowledge or capabilities. These are entirely contingent on the data and coding the human controller provides it with, why it is possible to limit the capabilities of the person skilled in the art to an appropriate level.
This thesis concludes that the current EPC formulation is well suited to handle the challenges posed by AI and AI-assisted inventions. As the EPC does not place focus on how an invention is conceived, AI assisted inventions remain patentable as long as they can properly disclose their inventions an fulfill the remaining criteria for patentability. For the EPO, it remains a vital task to keep the patentability criteria clear in order to provide the inventors with sufficient foreseeability to prevent them from protecting their inventions as trade secrets or equivalent, which does not result in public disclosure of technical advancements. Genom en analys av framåtblickande litteratur på området går det att utröna att uppfinnare kan använda AI och ML för att genomsöka tidigare känd teknik för att hitta nya möjligheter att vara nyskapande. EPO kan därutöver använda AI och ML för att strömlinjeforma utvärderingsmodellen för patenterbarhet och på ett mer precist sätt avgöra huruvida en uppfinning är ny eller bara en uppenbar utveckling av tidigare känd teknik. Det koncept i problemlösningsmetoden som potentiellt skulle behöva skrivas om på grund av AI och ML är fackmannabegreppet. Denna hypotetiska person tilldelas inför varje utvärdering av en patentansökan lämpliga kunskaper och färdigheter för att på ett lämpligt sätt kunna avgöra huruvida en uppfinnings lösning på ett objektivt tekniskt problem var uppenbart. AI besitter inga inneboende kunskaper eller färdigheter. Bestämningen av dessa är helt beroende av den data och kodning som tillförs av en mänsklig controller, varför det är möjligt att begränsa AIns färdigheter till en lämplig nivå.
Denna uppsats når slutsatsen att formuleringarna i EPC är tillräckligt flexibla för att kunna hantera de utmaningar som AI och AI-assisterade uppfinningar kan föra med sig. Då patenterbarhet enligt EPC inte är direkt beroende på hur en uppfinning har skapats, är AI-assisterade uppfinningar patenterbara under förutsättning att de kan lämna den information gällande uppfinningen som EPC ställer krav på, samt uppfyller resterande krav på patenterbarhet. För EPO är en viktig uppgift att tillhandahålla tydliga kriterier för patenterbarhet
på grund av att uppfinnare behöver förutsebarhet. Utan förutsebarhet kan
uppfinnare i större utsträckning vända sig till andra medel för att skydda sina uppfinningar, exempelvis i form av affärshemligheter, vilka inte resulterar i att allmänheten får ta del av den tekniska utveckling som följer därav. (Less)
