Arbetsrättens osynliga hand - Grundläggande antaganden, inneboende motsättningar och ideologiska skiften i den svenska arbetsrätten

Abstract
The overarching purpose of this thesis is to examine the relationship between labour law and the labour market, applying a combination of the legal doctrinal method and a social scientific approach. This is done through a historical study of the development of the two institutions of fixed-term employment and termination of employment due to redundancy, and how they have related to the parallel economic, political and ideological developments. The overarching purpose of this thesis is to examine the relationship between labour law and the labour market, applying a combination of the legal doctrinal method and a social scientific approach. This is done through a historical study of the development of the two institutions of fixed-term employment and termination of employment due to redundancy, and how they have related to the parallel economic, political and ideological developments. Furthermore, the thesis explores how these two institutions have impacted and have been impacted by the power balance between employer and employee organizations. The starting point of the thesis is the beginning of the 19th century, be-fore the two legal institutions can be said to have existed and extends until the 2020 agreement between some of the employer organizations, on one side, and some labour organizations, on the other side. The extensive timeframe enables a discussion beyond specific law changes.

Legal, political, economic and ideological structures are understood as parts of overarching systems, called accumulation regimes. The thesis examines changes within the structures that constitute the regimes, but also how different accumulation regimes have superseded each other. By comparing these changes, patterns and decisive differences emerge, which contributes to a deepened understanding of the separate parts, their relation to each other and the overall system which they are a part of.

In conclusion, the study illustrates that labour law has been characterized by a legally consolidated unequal power relation between employers and employees over the course of the examined period. This inequality has had a central function within the analysed accumulation regimes. The shifts in accumulation regimes have impacted labour law in ways extending beyond the conventional legal method, thereby indicating the significant degree of elasticity of said method. Furthermore, it is argued that policy-making and legal interpretation in the field of labour law is characterized by an ideological understanding of the relationship between labour law and the labour market. This obscures a true understanding of the relationship between the two. (Less)

Det övergripande syftet med den här föreliggande uppsatsen är att med hjälp av en kombination av den rättsdogmatiska metoden och den samhällsvetenskapliga undersöka arbetsrättens relation till arbetsmarknaden. Detta görs ge-nom en historisk undersökning av framväxten av de två rättsliga instituten visstidsanställningar och uppsägning på grund av arbetsbrist samt hur deras framväxt förhållit sig till den parallella ekonomiska, politiska och ideologiska utvecklingen. Juridiska, ekonomiska, politiska och ideologiska strukturer förstås som delar av övergripande system, så kallade ackumulationsregimer. Såväl förändring i de delar som utgör ackumulationsregimerna som hur olika ackumulationsregimer ersatt varandra undersöks. Genom att jämföra dessa förändringar kan sedan mönster och avgörande skillnader klarläggas, vilka bidrar till en fördjupad förståelse av de enskilda delarna, deras relation till varandra och det över-gripande systemet de ingår i.

Undersökningen visar att arbetsrätten på ett såväl individuellt som kollektivt plan över hela den undersökta tidsperioden präglats av ett juridiskt befäst ojämlikt maktförhållande mellan arbetsgivare och arbetstagare, och att denna ojämlikhet haft en central funktion i de undersöka ackumulationsregimerna. Ackumulationsregimernas förändringar har påverkat arbetsrätten på sätt som faller utanför den gängse juridiska metoden, vilket visar på metodens elastici-tet. Det argumenteras vidare för att arbetsrättslig reglering och lagtolkning präglas av en ideologisk förståelse av arbetsrättens relation till arbetsmarknaden vilken skymmer en verklig förståelse av relationen mellan de två.
