- The purpose of the study below is to examine how the societal use, especially regarding the municipal application, of police ordained private security guards in the public sphere relates to the regulation of this legal institution that came into being in the late 1970s? The study achieves this by conducting a historical review in order to explain why Sweden is basically alone in the world in applying a system of police-appointed civilians, usually employed in private companies and hired by public authorities to manage large parts of public safety. - The purpose of the study below is to examine how the societal use, especially regarding the municipal application, of police ordained private security guards in the public sphere relates to the regulation of this legal institution that came into being in the late 1970s? Applicable law is dealt with in length and the legislative work that preceded and came under current law has also been examined. The focus of the investigation is the exception rule in section 3 of the law (1980:578), which is currently applied as a main rule. The practice in the superior courts that has made this possible is reviewed before a summary of what the municipal application of security guards looks like at present is conducted. Extra focus is directed towards the so-called “Stockholm model” of mobile security guards and the survey concludes with a brief speculation as to whether the accelerating application of security guards in the municipalities is the starting point for the return of a municipal police force. - Nedanstående undersökning har som syfte att undersöka hur det samhälleliga användandet, framförallt gällande den kommunala tillämpningen, av ordningsvakter i det offentliga rummet förhåller sig till regleringen av rättsinstitutet som kom till i slutet på 1970-talet?
Undersökningen uppnår detta genom att utföra en historisk tillbakablick i syfte att förklara varför Sverige är i princip ensamt i världen om att tillämpa ett system med polisiärt förordnade civilpersoner, oftast anställda i privata bolag och anlitade av offentliga myndigheter.
Gällande rätt behandlas i längd och det lagstiftningsarbete som föregick och kom efter nu gällande lag har även granskats. Fokus för undersökningen är den undantagsregel i 3 § lagen (1980:578) om... Extra fokus tillägnas den s.k. “Stockholmsmodellen” med mobila ordningsvakter och undersökningen avslutas med en kort fundering om huruvida den accelererande tillämpningen av ordningsvakter i kommunerna är startskottet på återkomsten av den kommunal poliskår som avskaffades genom polisens förstatligande 1965.
