- Syftet med denna uppsats är att undersöka om postkoloniala strukturer påverkar den internationella barnrätten generellt. För att uppsatsens ska fylla sitt syfte har en fallstudie gjorts på CRC (Convention on the Rights of the Child) och ACRWC (African Charter on the Rights and Welfare of the Child) och uppsatsens frågeställning lyder;
Påverkar de postkoloniala strukturerna den afrikanska barnrätten? Om ja, på vilket sätt?
Som teori används postkolonial teori med fokus på Frantz Fanons, Edward Saids och Homi K. Bhabhas bidrag till teorin och med postkoloniala strukturer åsyftas i uppsatsen de tre teoretiska begrepp som används som analysverktyg; eurocentrism, reproduktion och internalisering. Som teori används postkolonial teori med fokus på Frantz Fanons, Edward Saids och Homi K. Bhabhas bidrag till teorin och med postkoloniala strukturer åsyftas i uppsatsen de tre teoretiska begrepp som används som analysverktyg; eurocentrism, reproduktion och internalisering. Metoden som används är kvalitativ innehållsanalys och analysen genomförs med hjälp av de tre analysverktygen som är utvalda med grund i nämnda forskares bidrag till teorin.
Slutsatsen är att det finns tecken på postkoloniala strukturer i form av eurocentrism och reproduktion i CRC och tecken på postkoloniala strukturer i form av internalisering i ACRWC. Med det sagt är tecken på eurocentrism och reproduktion starkare i CRC än vad tecken på internalisering är i ACRWC är. Svaret på frågeställningen är således att postkoloniala strukturer kan påverka afrikansk barnrätt genom eurocentriska och reproduktiva tendenser i CRC men att AU har uppmärksammat dessa risker och genom ACRWC minimerat effekterna av de postkoloniala strukturerna och därmed begränsat konsekvenserna av dessa för de afrikanska barnen. - The aim of this thesis is to investigate if postcolonial structures affect international children's law in general. In order for the thesis to fulfill its purpose, I studied two children's rights documents, the CRC (Convention on the Rights of the Child) and the ACRWC (African Charter on the Rights and Welfare of the Child). The thesis aims to answer the following question:
Do colonial structures affect the rights of African children's rights law? If yes, in what way?
The thesis uses the postcolonial theory with a specific focus on the contributions of Frantz Fanon, Edward Saids and Homi K. Bhabha. The method used is a qualitative content analysis and the analysis is implemented with the three theoretical concepts; eurocentrism,... (More) - The aim of this thesis is to investigate if postcolonial structures affect international children's law in general. In order for the thesis to fulfill its purpose, I studied two children's rights documents, the CRC (Convention on the Rights of the Child) and the ACRWC (African Charter on the Rights and Welfare of the Child). The thesis aims to answer the following question:
Do colonial structures affect the rights of African children's rights law? If yes, in what way?
The thesis uses the postcolonial theory with a specific focus on the contributions of Frantz Fanon, Edward Saids and Homi K. Bhabha. The method used is a qualitative content analysis and the analysis is implemented with the three theoretical concepts; eurocentrism, reproduction and internalization. Postcolonial structures in this thesis are limited to these three theoretical concepts which are derived from the mentioned authors.
This thesis shows there are signs of postcolonial structures in terms of eurocentrism and reproduction in the CRC and signs of postcolonial structures in terms of internalization in the ACRWC. However, the signs of eurocentrism and reproduction are stronger in the CRC that the signs of internalization in the ACRWC. The answer to my question is thus that the postcolonial structures may affect the African children's rights through eurocentric and reproductive tendencies in the CRC but with a limited effect thanks to AU acknowledging the risks and adopting the ACRWC.
