Penningtvätt inom försäkringsbranschen sker genom att tillgångar, som härrör från brottslig verksamhet, investeras i en försäkring vilket gör det svårt att spåra tillgångarnas ursprung. När pengarna sedan betalas ut till försäkringstagaren, eller förmånstagaren, förvandlas de illegalt förvärvade tillgångarna till vita pengar med legitim status.

Penningtvätt utgör ett stort problem för EU:s finansiella system vilket medför att EU allt som oftast skärper kampen mot denna typ av verksamhet. Penningtvätt inom försäkringsbranschen sker genom att tillgångar, som härrör från brottslig verksamhet, investeras i en försäkring vilket gör det svårt att spåra tillgångarnas ursprung. När pengarna sedan betalas ut till försäkringstagaren, eller förmånstagaren, förvandlas de illegalt förvärvade tillgångarna till vita pengar med legitim status.

Penningtvätt utgör ett stort problem för EU:s finansiella system vilket medför att EU allt som oftast skärper kampen mot denna typ av verksamhet. Regelverket om åtgärder mot penningtvätt har under de senaste åren genomgått stora förändringar. För att kunna bekämpa penningtvätt behöver finansiella verksamhetsutövare ha effektiva verktyg. Uppsatsen syftar till att utreda och kartlägga de skyldigheter, avseende penningtvätt, som åvilar svenska försäkringsbolag enligt lag. Ambitionen med uppsatsen är även att påvisa det faktum att skadeförsäkringsbolag inte omfattas av penningtvättsregelverket vilket är ett stort bekymmer.

Enligt penningtvättsregelverket åvilar det livförsäkringsbolagen att identifiera och bedöma den risk för penningtvätt som är knutna till kunder, produkter som försäkringsbolagen erbjuder, de geografiska områden som försäkringsbolagen verkar inom och inom de distributionskanaler de använder för att betjäna sina kunder. Därutöver är livförsäkringsbolagen bland annat skyldiga att rapportera och lämna uppgifter om kunder och transaktioner till finansunderrättelseenheten vid misstanke om penningtvätt. Skadeförsäkringsbolag har inte samma skyldigheter med anledning av att de inte omfattas av penningtvättsregelverket. För att skadeförsäkringsbolag i Sverige ska kunna arbeta mer proaktivt mot penningtvätt måste även skadeförsäkringsrörelse omfattas. För att penningtvätt ska kunna bekämpas måste alla finansiella strömmar regleras genom penningtvättsregelverket. (Less)

Money laundering in the insurance industry takes place by investing in insurance with assets from criminal activities, which makes it difficult to trace the origin of the money. Once the money is paid to policyholders or beneficiaries, the illegally acquired assets are transformed into laundered money.

Money laundering is a major problem for the EU’s financial system why the regulations against money laundering has increasingly sharpened the recent years. In order to combat money laundering, financial operators need to have effective tools to prevent and avoid money laundering. Money laundering in the insurance industry takes place by investing in insurance with assets from criminal activities, which makes it difficult to trace the origin of the money. Once the money is paid to policyholders or beneficiaries, the illegally acquired assets are transformed into laundered money.

Money laundering is a major problem for the EU’s financial system why the regulations against money laundering has increasingly sharpened the recent years. In order to combat money laundering, financial operators need to have effective tools to prevent and avoid money laundering. The thesis aims to investigate and map the obligations, regarding money laundering, that lies on insurance companies in Sweden according to law. The ambition of the thesis is also to demonstrate the fact that none-life insurance companies are not covered by the money laundering regulations is a major concern.

According to the money laundering regulations, it is the responsibility of the life insurance companies to identify and assess the risk of money laundering associated with customers, products that the insurance companies offer, the geographical areas in which the insurance companies operate and the distribution channels they use to serve their customers. In addition, the life insurance companies are for example obliged to report and provide information about customers and transactions to the financial intelligence unit in case of suspicion of money laundering. The same obligations do not apply to non-life insurance companies due to the fact that they are not covered by the money laundering regulation. In order for non-life insurance companies in Sweden to be able to work more proactively against money laundering, non-life insurance companies must also be covered by the regulations. In order for money laundering to be combated, all different kind of financial flows must be regulated by the money laundering regulations. (Less)
