Inkorporeringen av barnkonventionen i svensk lag och dess effekter på bedömningen av barnets bästa i utlänningslagen

Abstract
In light of the incorporation of the Convention on the Rights of the Child (CRC) in Swedish law on January 1st, 2020, the purpose of the thesis is to examine whether the convention has had the impact on the application of law that the legislator intended when the law was incorporated. The purpose is fulfilled by answering the question of how the incorporation of the CRC into Swedish law has affected the assessment of the best interests of the child when particularly distressing circumstances are the basis of an application for residence permit. In light of the incorporation of the Convention on the Rights of the Child (CRC) in Swedish law on January 1st, 2020, the purpose of the thesis is to examine whether the convention has had the impact on the application of law that the legislator intended when the law was incorporated. The purpose is fulfilled by answering the question of how the incorporation of the CRC into Swedish law has affected the assessment of the best interests of the child when particularly distressing circumstances are the basis of an application for residence permit. The three parts that are examined are the decision-making process, how the assessment of the circumstances that formed the basis for the child's adaptation to Sweden has been made and whether the child's best interests are used as an open concept or not. The legal dogmatic method is used to answer the questions by processing the material used in relation to the doctrine of legal sources. The work is based on a legal development perspective, which is used to explain the changes in current law by comparing the legal situation before and after a specific change in the law.

In the preparatory work, the government has stated that the best interests of the child shall be assessed in each individual case. The paragraph in the Swedish Aliens Act regulating residence permits based on particularly distressing circumstances requires an overall assessment of all circumstances within which a balance of interests must be made, where the best interests of the child constitute one of these interests. Two legal cases from before and after incorporation are used to show that the view of the child's best interests has changed in case law. The most important conclusions that are drawn are that the incorporation has resulted in the best interests of the child being used to a greater extent as a procedure by the courts. Although, when it comes to applying the child's best interests as an open concept, not much has changed. Nor in the individual assessment of the circumstances that have been invoked as particularly distressing. The child's will has begun to be become more important in the assessment, but the child’s grounds for asylum are not tried completely independently against their family. (Less)

Mot bakgrund av inkorporeringen av barnkonventionen 1 januari 2020 är syftet med uppsatsen att undersöka om konventionen fått det genomslag i rättstillämpningen som lagstiftaren avsåg vid införandet av lagen. Syftet uppnås genom att frågeställningen hur inkorporeringen av barnkonventionen i svensk lag har påverkat bedömningen av barnets bästa när särskilt ömmande omständigheter utgör grund för uppehållstillstånd i 5 kap. 6 § utlänningslagen (2005:716), UtlL besvaras. Till grund för arbetet ligger ett rättsutvecklingsperspektiv, som används för att förklara förändringarna i gällande rätt genom att jämföra rättsläget före och efter en specifik lagändring.

Regeringen har i förarbeten uttalat att barnets bästa ska bedömas i varje individuellt fall. I 5 kap. 6 § UtlL görs en helhetsbedömning av samtliga omständigheter inom vilken en intresseavvägning ska göras, där barnets bästa utgör ett av dessa intressen. MIG 2015:4 och MIG 2020:24 är två rättsfall från före respektive efter inkorporeringen som visar på att synen på barnets bästa förändrats i rättspraxis. De viktigaste slutsatserna som dras är att inkorporeringen resulterat i att barnets bästa i större utsträckning används som ett tillvägagångssätt av rättstillämparen. Däremot har tillämpningen av barnets bästa som ett öppet koncept inte förändrats utan förblir bunden av rättsliga presumtioner, inte heller den enskilda bedömningen av omständigheterna som åberopats som särskilt ömmande. Barnets vilja har börjat få större betydelse i bedömningen men barns asylskäl prövas inte helt självständigt mot deras familj. (Less)
