- Abstract
- The principle of immediateness is a fundamental principle in Swedish procedural law. In the government bill 2020/21:209 the government proposes a restriction of the principle, through early examinations, with the aim to increase the flexibility of large criminal cases without decreasing the rule of law.
The purpose of the essay is to answer the following questions; are the motives from when the principle of immediateness was created still relevant today and how is the rule of law affected if the principle of immediateness is restricted.
The essay presents the principle of immediateness from a legal-historical perspective, a contemporary perspective and a potential future perspective. The essay presents the principle of immediateness from a legal-historical perspective, a contemporary perspective and a potential future perspective. The essay also describes the rule of law and some basic criminal procedures in order to increase the reader’s understanding of the debate.

- Omedelbarhetsprincipen är en grundläggande princip i den svenska straffprocessrätten. I lagförslaget prop. 2020/21:209 föreslår regeringen en inskränkning av principen, genom tidiga förhör, i syfte att skapa ökad flexibilitet i stora brottmål. Ett krav från regeringens sida är att lagförslaget inte försämrar rättssäkerheten.
Uppsatsen syftar till att granska omedelbarhetsprincipen utifrån frågeställningarna; är motiven för omedelbarhetsprincipens införande relevanta än idag, samt hur påverkas rättssäkerheten om omedelbarhetsprincipen inskränks.
Uppsatsen behandlar omedelbarhetsprincipen ur ett rättshistoriskt perspektiv, ur ett nutida perspektiv samt ur ett framåtblickande perspektiv. Uppsatsen redogör även vad som avses med...
