Uppsatsen undersöker hur reglerna kring familjeåterförening för flyktingar och alternativt skyddsbehövande har förändrats i Sverige sedan 2016, först med införandet av den så kallade begränsningslagen och från 2021 med ändringar i utlänningslagen. Uppsatsen inleds med att gå igenom grundläggande begrepp inom migrationsrätt som relaterar till familjeåterförening. Sedan diskuteras hur rätten eller möjligheten till familjeåterförening definierats i internationella konventioner, med fokus på Europeiska konventionen om skydd för de mänskliga rättigheterna, och i EU-lag med fokus på familjeåterföreningsdirektivet. Uppsatsen undersöker hur reglerna kring familjeåterförening för flyktingar och alternativt skyddsbehövande har förändrats i Sverige sedan 2016, först med införandet av den så kallade begränsningslagen och från 2021 med ändringar i utlänningslagen. Uppsatsen inleds med att gå igenom grundläggande begrepp inom migrationsrätt som relaterar till familjeåterförening. Sedan diskuteras hur rätten eller möjligheten till familjeåterförening definierats i internationella konventioner, med fokus på Europeiska konventionen om skydd för de mänskliga rättigheterna, och i EU-lag med fokus på familjeåterföreningsdirektivet. Efter detta så visar uppsatsen hur rätten till familjeåterförening definierades i utlänningslagen före införandet av begränsningslagen, och hur rätten formats av EU-lag och internationella konventioner. Efter detta beskrivs hur begränsningslagen begränsade rätten till familjeåterförening, vilka lösningar som användes för att göra detta, problem som uppstod och hur praxis från Migrationsöverdomstolen löste dessa problem. Sedan diskuteras hur familjeåterförening definierats i utlänningslagen från och med begränsningslagens utgång, med en diskussion om i vilken utsträckning det kan anses finnas en kontinuitet i målen mellan begränsningslagen och den nya utlänningslagen. Till sist görs en analys av begränsningslagens och den nya utlänningslagens lösningar för att uppnå minimikraven enligt EU-lag och internationella konventioner, och i vilken utsträckning lagarna gått utöver minimikraven i ljuset av nya rättsfall från Europadomstolen. This essay examines how the rules surrounding family reunification for refugees and persons with subsidiary protection have changed in Sweden since 2016, at first with the introduction of the so-called Temporary law and from 2021 with changes in the Swedish Aliens Act. The essay begins with defining important terms within migration law relating to family reunification. Then, the essay discusses how the right or possibility to family reunification has been defined in international conventions, with a focus on the European Convention on Human Rights, and in EU-law with a focus on the family reunification directive. After that, the essay will show how the right to family reunification was defined in the Aliens Act prior to the introduction of the Temporary Law, and how the right had been formed by EU law and international conventions. Then, the essay will explain how the Temporary Law limited the right to family reunification, which solutions were used to do this, problems that arose and how praxis from the Swedish Migration Court of Appeal solved these problems. After this, it will be discussed how family reunification has been defined in the Swedish Aliens Act after the expiration of the Temporary Law, with a discussion on to what extent there can be said to be a continuity in goals between the Temporary Law and the new Aliens Act.
