Principen om barnets bästa ska beaktas i lagstiftning, administrativa beslut och andra åtgärder som berör barn. Innebörden av principen om barnets bästa och principens genomslag i rättstillämpning är omdiskuterad. Principen om barnets bästa återfinns i lag (1990:52) om vård av barn och unga (LVU) som en portalbestämmelse och ska påverka alla beslut som tas enligt lagen. Diskussioner om stärkt barnrättsperspektiv i tvångsvårdslagstiftningen föranleder förslag till lagändringar. I lagförarbete föreslår utredare införande av barnets bästa som ett självständigt rekvisit i en bestämmelse om upphörande av vård i LVU.

Principen om barnets bästa ska beaktas i lagstiftning, administrativa beslut och andra åtgärder som berör barn. Innebörden av principen om barnets bästa och principens genomslag i rättstillämpning är omdiskuterad. Principen om barnets bästa återfinns i lag (1990:52) om vård av barn och unga (LVU) som en portalbestämmelse och ska påverka alla beslut som tas enligt lagen. Diskussioner om stärkt barnrättsperspektiv i tvångsvårdslagstiftningen föranleder förslag till lagändringar. I lagförarbete föreslår utredare införande av barnets bästa som ett självständigt rekvisit i en bestämmelse om upphörande av vård i LVU.

Förevarande uppsats undersöker hur införande av barnets bästa som ett självständigt rekvisit förhåller sig till kraven på rättssäkerhet. Uppsatsen utreder innebörden av barnets bästa och beaktar om en definition av begreppet kan utrönas i beaktande av FN:s konvention om barnets rättigheter och nationell rätt. Barnets bästa som princip och rekvisit diskuteras kritiskt utifrån ett rättssäkerhetsperspektiv. Synliggörande av rättssäkerhetsperspektivets olika dimensioner uppnås genom beaktande av olikartad doktrin. Uppsatsen utgår från rättsdogmatisk och rättsanalytisk metod. Rättsdogmatisk metod är användbar i utredning av gällande rätt. Då uppsatsen berör ett förslag till lagändring och principen om barnets bästa i förhållande till rättssäkerhetskravet tillämpas också rättsanalytisk metod för att uppnå en bredare diskussion.

Uppsatsens resultat indikerar att principen om barnets bästa inte har en enhetlig definition. Definitionen av begreppet barnets bästa varierar beroende på rättstillämpning i enskilda fall, vilket försvårar förutsebarhet då myndighetsutövning inte kan utgå strikt från rättsreglerna. Ska barnets bästa formuleras som ett självständigt rekvisit med avgörande betydelse i LVU måste bedömningsgrunder preciseras i lagstiftningen, vilket riskerar underminera principens flexibilitet. Rättssäkerhet förutsätter tydlig lagstiftning och barnets bästa som princip och rekvisit kan inte anses tydligt utan närmare preciseringar. (Less)
Abstract
The principle of the best interests of the child shall be taken into consideration in legislation, administrative decisions and other measures concerning children. The meaning of the best interests of the child and the principle’s impact on the application of law is disputed. The principle of the best interests of the child can be found in the Act with Special provisions on the care of Young Persons (LVU) and it shall affect every decision made according to the law. Discussions concerning a strengthened child rights perspective in the compulsory care legislation gives rise to proposals for amendments to the law. The principle of the best interests of the child shall be taken into consideration in legislation, administrative decisions and other measures concerning children. The meaning of the best interests of the child and the principle’s impact on the application of law is disputed. The principle of the best interests of the child can be found in the Act with Special provisions on the care of Young Persons (LVU) and it shall affect every decision made according to the law. Discussions concerning a strengthened child rights perspective in the compulsory care legislation gives rise to proposals for amendments to the law. In legislative history investigators propose that the best interests of the child should be imposed as a necessary prerequisite in a provision on termination of compulsory care in LVU.

The present thesis examines how imposition of the best interests of the child as a necessary prerequisite relates to the requirement of the rule of law. The thesis investigates the meaning of the child's best interests and considers whether a definition can be ascertained in the light of the UN Convention on the Rights of the Child and national legislation. The best interests of the child as a matter of principle and necessary prerequisite is critically discussed from a rule of law-perspective. Visibility of the different dimensions of the rule of law-perspective is achieved by taking into account different literature of jurisprudence. The thesis is based on a legal dogmatic and legal analytical method. Legal dogmatic method is useful in the investigation of established law. As the thesis concerns a bill and the principle of the best interests of the child in relation to the rule of law, a legal analytical method is also applied to achieve a broader discussion.

The result of the thesis indicates that the principle of the best interests of the child does not have a uniform definition. As the definition of the best interests of the child varies depending on the application of law in individual cases, predictability is difficult to achieve as the exercise of authority cannot be strictly based on the legal rules. If the best interests of the child are to be formulated as a necessary prerequisite with decisive importance in LVU, assessment criteria must be specified in the legislation, which, however, risks undermining the principle’s flexibility. The rule of law presupposes clear legislation and the best interests of the child as a principle and necessary prerequisite cannot be considered clear without further specifications. (Less)
