Abstract (Swedish)
När en entreprenad färdigställts ska den enligt AB 04 besiktigas innan den anses avlämnad och en mängd rättsverkningar inträder. Denna uppsats ämnar att kritiskt granska besiktningsinstitutet som det ser ut enligt AB 04.

Entreprenadrätten som område har under 2000-talet fört en alltmer framträdande roll inom juridiken. Det har bland annat fått till följd att Högsta domstolen meddelat ett ökat antal prejudikat på entreprenadrättens område. Det har också lett till att HD tagit fram en särskild tolkningsmetod för entreprenadavtal. För att ge en bakgrund och att öka förståelsen inleds uppsatsen med en allmän framställning av entreprenadrättens särdrag och HD:s tolkningsmetod.

Entreprenadrätten som område har under 2000-talet fört en alltmer framträdande roll inom juridiken. Det har bland annat fått till följd att Högsta domstolen meddelat ett ökat antal prejudikat på entreprenadrättens område. Det har också lett till att HD tagit fram en särskild tolkningsmetod för entreprenadavtal. För att ge en bakgrund och att öka förståelsen inleds uppsatsen med en allmän framställning av entreprenadrättens särdrag och HD:s tolkningsmetod.

Entreprenadrättens utveckling till trots ser besiktningsinstitutet mer eller mindre ut på samma sätt som det gjort i över 70 år. Det är tydligt att det finns historiska skäl till att besiktningsinstitutet ser ut som det gör. Med anledning av detta inleds uppsatsen med en historisk tillbakablick på besiktningsinstitutet i äldre editioner av AB.

Uppsatsens huvudsakliga syfte är att undersöka och kritiskt granska besiktningsinstitutet sådant det ser ut i den nu gällande versionen av AB, nämligen AB 04. Besiktningsinstitutet granskas utifrån besiktningsmannens roll, be-siktningens rättsverkningar och besiktningens rättsliga betydelse. Eftersom besiktningsinstitutet är starkt kopplat till felbegreppet i AB 04 avhandlas även detta.

Uppsatsen kommer visa att besiktningsinstitutet är daterat och inte särskilt väl avvägt i förhållande till den betydelse som besiktningsmannens utlåtande får i processer vid domstol. En kort utblick görs på hur det fungerar i våra grannländer Danmark och Norge, denna visar att deras besiktningsregler är mer välavvägda och moderna. (Less)

When a building contract is finished the building needs to be inspected, in accordance with the Swedish standard construction contract AB 04, before it is handed over to the buyer and other legal effects take place. This essay intends to critically examine the inspection process as it is stipulated in AB 04.

Construction contract law as a legal area has come to play a more prominent role in Sweden during the 2000s. This has, among other things, led to the Swedish Supreme Court passing an increased number of precedents in the area. This essay intends to critically examine the inspection process as it is stipulated in AB 04.

Construction contract law as a legal area has come to play a more prominent role in Sweden during the 2000s. This has, among other things, led to the Swedish Supreme Court passing an increased number of precedents in the area. This has also led to the Swedish Supreme Court constructing a method of interpretation of construction contracts. To give a background and increase understanding the essay begins with a general presentation of the special features of construction contract law and the Swedish Supreme Courts method of interpretation of construction contracts.

Despite the development in the field of construction contract law the inspection process is the same as it has been for over 70 years. There are clear historical reasons why the inspection process is as it is. This motivates looking back at the history of the inspection process.

The main purpose of the essay is however to examine the inspection process as it is stipulated in the current version of AB – AB 04. The inspection process will be examined in relation to the inspector’s role, the inspections legal effects and its legal importance. Because the inspection is strongly connected to the concept of defects on a building contract the concept will also be presented.

The essay will show that the inspection process is dated and not well balanced in relation to the importance the inspector’s statement is given in court proceedings. A short outlook on our neighbours Denmark and Norway will be presented. The outlook shows that their rules on inspection are more well balanced and modern. (Less)
