- Denna uppsats behandlar PAL och lagens tillämplighet på ansvarsfrågan hos autonoma system. Ett autonomt system är ett tekniskt och komplext system som har möjligheten till självlärande och eget beslutsfattande.
Begreppet autonomi betyder självstyre och olika nivåer av detta används för att bestämma om autonomin är stark eller svag.
Syftet med uppsatsen är att utreda huruvida PAL i dess nuvarande form kan tackla de rättsliga utmaningarna med autonoma system. Dessa utmaningar kommer bland annat i form av brist på transparens, svårigheter vid definition av begrepp samt bevisningssvårigheter. Exempel på detta är begreppet produkt samt säkerhetsbrist i PAL, samt skadelidandes problem att styrka orsakssambandet. Vidare så föreligger ett... Exempel på detta är begreppet produkt samt säkerhetsbrist i PAL, samt skadelidandes problem att styrka orsakssambandet. Vidare så föreligger ett problem med bestämmelsen om utvecklingsskador, som negativt påverkar ansvarsfördelningen i PAL och därav skapar ett ansvarsvakuum.
Det identifierade huvudproblemen med PAL skapar rum för diskussion om hur problemen ska åtgärdas. Några exempel på detta är en utvidgning av produktbegreppet, lagstiftning om hur programmering av autonoma system ska ske samt om den traditionella betydelsen av adekvat kausalitet behöver omskrivas för att passa in på autonoma system och därmed minska skadelidandes bevissvårigheter. När diskussionen förs så är det viktigt att man framhäver samhällsnyttan hos autonoma system och därmed skapar en balans mellan tillit och fortsatt teknisk utveckling på området. (Less) - Abstract
- This thesis examines the Swedish Product Liability Act (PAL) and the law's applicability to the issue of liability in autonomous systems. An autonomous system is a technical and complex system that has the opportunity for self- learning and own decision-making. The term autonomy means “self- control” and different levels of this are used to determine whether the autonomy is strong or weak.
The purpose of the thesis is to investigate whether PAL, in its current form, can tackle the legal challenges with autonomous systems. These challenges come in the form of a lack of transparency, difficulties in defining concepts, and evidentiary difficulties. Examples of this are the concept of the term product and security flaws in PAL, as well as the... (More) - This thesis examines the Swedish Product Liability Act (PAL) and the law's applicability to the issue of liability in autonomous systems. An autonomous system is a technical and complex system that has the opportunity for self- learning and own decision-making. The term autonomy means “self- control” and different levels of this are used to determine whether the autonomy is strong or weak.
The purpose of the thesis is to investigate whether PAL, in its current form, can tackle the legal challenges with autonomous systems. These challenges come in the form of a lack of transparency, difficulties in defining concepts, and evidentiary difficulties. Examples of this are the concept of the term product and security flaws in PAL, as well as the injured party's problem of proving the causal link. Furthermore, there is a problem with the regulation on developmental injuries, which negatively affects the division of responsibilities in PAL and thereby creates a liability vacuum.
The identified main problems with PAL create room for discussion on how to begin to solve these problems. Some examples of this are an extension of the product concept, legislation on how the programming of autonomous systems should take place, and whether the traditional meaning of adequate causality needs to be rewritten to fit into autonomous systems and thereby reduce the victims' evidentiary difficulties. When the discussion takes place, it is important to emphasize the societal benefits of autonomous systems and thereby create a balance between trust and continued technical development in the area.
