- I artikel 107.1 i FEUF stadgas ett förbud för EU:s medlemsstater att vidta statliga stödåtgärder som skapar, eller kan skapa, konkurrenssnedvridande effekter på EU:s inre marknad. Det breda förbud mot statligt stöd som artikel 107.1 FEUF stadgar, har dock några undantag som ska möjliggöra för medlemsstaterna att i vissa situationer utge statligt stöd, trots att det kan få konkurrenssnedvridande effekter. Ett sådant undantag är artikel 107.3 b FEUF, som berättigar statligt stöd om det vidtas av en medlemsstat i syfte att avhjälpa en allvarlig störnings i medlemsstatens ekonomi. Det breda förbud mot statligt stöd som artikel 107.1 FEUF stadgar, har dock några undantag som ska möjliggöra för medlemsstaterna att i vissa situationer utge statligt stöd, trots att det kan få konkurrenssnedvridande effekter. Ett sådant undantag är artikel 107.3 b FEUF, som berättigar statligt stöd om det vidtas av en medlemsstat i syfte att avhjälpa en allvarlig störnings i medlemsstatens ekonomi. Mot bakgrund av den ekonomiska kris som drabbade Europa med anledning av de restriktioner som infördes för att förhindra spridningen av covid-19, blev den möjlighet till undantag från förbudet mot konkurrenssnedvridande statligt stöd som artikel 107.3 b FEUF tillhandahåller högaktuell.
Ansvaret för tillämpningen av artikel 107.3 b FEUF innehas av EU-kommissionen. Den här uppsatsen har utrett hur kommissionens tillämpning av artikel 107.3 b FEUF har sett ut under covid-19-pandemin och vilka rättssäkerhetsbrister som präglar kommissionens rättstillämpning.
Den tillfälliga ramen som utfärdats av kommissionen med anledning av covid-19-pandemin och som ska vägleda tillämpningen av artikel 107.3 b FEUF, har utvidgat tillämpningsområdet för bestämmelsen. Ur rättssäkerhetssynpunkt har utvidgningen i sig inte konstaterats vara problematisk, till skillnad från kommissionens dominanta roll i rättstillämpningen. Kommissionens både normgivande och rättstillämpande roll talar för bristande maktdelning. Problematiken med den bristande maktdelningen förstärks av att tillämpningen av artikel 107.3 b FEUF är beroende av skönsmässiga bedömningar, vilket gör att tillämpningen av bestämmelsen i sin helhet kan konstateras lida av formella rättssäkerhetsbrister. The prohibition of distorting state aid does however have exceptions, article 107.3 b TFEU being one of them. The provision states a justification for distorting state aid if the aid aims to remedy a serious disturbance in the economy of a member state. The European Commission is responsible for the application of article 107.3 b TFEU. This essay examines the Commission’s application of article 107.3 b TFEU during the covid-19 pandemic from a perspective of legal certainty.
The temporary framework, issued by the Commission by reason of the covid-19-pandemic, has extended the scope of application for article 107.3 b TFEU. From a perspective of legal certainty, the extended scope of application of article 107.3 b TFEU does not appear as problematic itself. However, the insufficient division of powers, along with a wide margin of discretion in the application of the provision, gives the Commission excessive power, which is a formal legal certainty problem.
