Covid-19 har resulterat i en problematik på flertal arbetsplatser och de ovaccinerade arbetstagarna kan anses utgöra en säkerhetsrisk, som arbetsgivaren i sin tur har en skyldighet att förhindra. Det har därmed uppstått en fråga huruvida införandet av ett vaccinationskrav kan ses som en nödvändig åtgärd. Syftet med denna uppsats är att belysa frågan gällande vaccinationskrav på arbetsplatsen och i vilken omfattning arbetsgivaren kan införa kravet i förhållande till arbetstagarens kroppsliga integritet. Uppsatsen ska undersöka de arbetsrättsliga förutsättningar vid införandet av vaccinationskrav och även utforska om arbetsgivaren kan inrätta kravet för fortsatt eller anpassat arbete.

Covid-19 har resulterat i en problematik på flertal arbetsplatser och de ovaccinerade arbetstagarna kan anses utgöra en säkerhetsrisk, som arbetsgivaren i sin tur har en skyldighet att förhindra. Det har därmed uppstått en fråga huruvida införandet av ett vaccinationskrav kan ses som en nödvändig åtgärd. Syftet med denna uppsats är att belysa frågan gällande vaccinationskrav på arbetsplatsen och i vilken omfattning arbetsgivaren kan införa kravet i förhållande till arbetstagarens kroppsliga integritet. Uppsatsen ska undersöka de arbetsrättsliga förutsättningar vid införandet av vaccinationskrav och även utforska om arbetsgivaren kan inrätta kravet för fortsatt eller anpassat arbete.
Med hjälp av den rättsdogmatiska metoden har rättskällorna Europakonventionen, nationell lagstiftning, förarbeten, praxis och doktrin undersökts. För att få en helhetsbild över vårt ämne har andra källor används såsom tidskrifter, lagkommentarer, artiklar och publiceringar från olika myndigheter vilket räknas till den juridiska metoden.
Den arbetsrättsliga undersökningen resulterar i en analys där arbetstagarens skydd för den kroppsliga integriteten diskuteras i förhållande till vilken del av arbetsmarknaden denne tillhör. Vidare behandlar analysen främst de olika förutsättningar som har visats sig vara av betydelse i en intresseavvägning mellan arbetsgivarens intresse och arbetstagarens kroppsliga integritet. Analysen bidrar med ett resonemang kring de möjliga arbetsrättsliga åtgärder som arbetsgivaren hade kunnat vida mot ovaccinerade arbetstagare. (Less)

The covid-19 pandemic has contributed to a problematic situation in workplaces due to the safety risk unvaccinated employees entail, which the employer has an obligation to prevent. The question is whether a vaccination requirement can be seen as a necessary measure. The purpose of this essay is to illustrate the workplace related requirement of vaccination and to what extent the employer can impose the demand in relation to the employee's physical integrity. The essay will examine the possibilities to statute a requirement of vaccination from a labor law perspective. The following question is whether the employer can establish the requirement for continued or adapted work.

The question is whether a vaccination requirement can be seen as a necessary measure. The purpose of this essay is to illustrate the workplace related requirement of vaccination and to what extent the employer can impose the demand in relation to the employee's physical integrity. The essay will examine the possibilities to statute a requirement of vaccination from a labor law perspective. Using the legal dogmatic method, the legal sources such as the European Convention, national legislation, preparatory work, case law and doctrine have been examined. To get a deeper understanding of the subject, other sources have been used such as legal commentaries, articles and publications from various authorities, which is included in the legal method.
The judicial inquiry results in an analysis which processes the employee ́s physical integrity and how it is affected by the different sides of the labor market. Furthermore, the analysis examines the balance of interest between the employer and the employee and which aspects are decisive. The analysis also provides an argument about the possible measures that the employer can use against unvaccinated workers. (Less)
