I svensk rätt tillämpas asperationsprincipen vid straffvärdebedömning av flerfaldig brottslighet. Vid flerfaldig brottslighet ska ett gemensamt straffvärde bestämmas och domstolen utgår från det allvarligaste brottets straffvärde och de övriga gärningarnas straffvärden reduceras i en fallande skala. Detta system har mött kritik i form av att påföljderna vid flerfaldig brottslighet blir för milda i proportion till brottets allvar. Regeringen tillsatte en utredning genom kommittédirektiv 2021:56 en skärpt syn på flerfaldig brottslighet som har till uppgift att överväga och föreslå ändringar av strafflagstiftningen som ger uttryck för en skärpt syn på flerfaldig brottslighet.

Uppsatsen syftar till att studera asperationsprincipen utifrån de straffrättsliga principerna om proportionalitet och humanitet. Syftet är även att se hur dessa principer kan ha en inverkan på möjligheterna att ändra lagstiftningen enligt regeringens direktiv samt att se om kriminalpolitiken spelar en större roll än principerna. För att uppnå detta syfte ska det genom en rättsdogmatisk metod redogöras för gällande rätt och motiven bakom gällande rätt samt bakgrunden till dagens reglering. Utöver detta görs också en utredning kring principerna och deras betydelse i straffrätten samt hur kriminalpolitiken spelar in på lagstiftningsprocessen.

De slutsatser som dragits är att rättsprinciper kan ses som vägledande och ett uttryck för lagstiftarens värderingar men att de går att åsidosättas om en annan princip väger tyngre. I detta fall visas i gällande rätt att humanitetsprincipen sätts före proportionalitetsprincipen i frågan om straffvärdebedömningen och straffskalemaximum vid flerfaldig brottslighet. Det visas även löpande i uppsatsen att de motiv som ligger bakom asperationsprincipen är grundade i främst humanitet men även vedergällningstanken och därmed en relativ proportionalitet. Angående vilket roll kriminalpolitiken spelar går det inte att utesluta att det är politiker som är de yttersta lagstiftarna och således är kriminalpolitiken en viktig del. (Less)
Abstract
In Swedish law, the principle of asperation is applied when estimating the penal value for multiple offences. In the case of multiple offences, a common penal value is determined and the court starts from the most serious offence, with the penal value of the other offences being reduced on a descending scale. This system has been criticized for making penalties for multiple offences too lenient in relation to the seriousness of the offence. The Government appointed an inquiry by Committee Directive 2021:56 on a stricter approach to multiple offences, with the task of considering and proposing amendments to criminal legislation that reflect a stricter approach to multiple offences.

In Swedish law, the principle of asperation is applied when estimating the penal value for multiple offences. In the case of multiple offences, a common penal value is determined and the court starts from the most serious offence, with the penal value of the other offences being reduced on a descending scale. This system has been criticized for making penalties for multiple offences too lenient in relation to the seriousness of the offence. The Government appointed an inquiry by Committee Directive 2021:56 on a stricter approach to multiple offences, with the task of considering and proposing amendments to criminal legislation that reflect a stricter approach to multiple offences.

The aim of the paper is to study the asperation principle according to penal law principles of proportionality and humanity. The purpose is also to see how these principles may have an impact on the possibilities of amending the legislation according to government directives and to see whether criminal policy plays a greater role than the principles themselves. In order to achieve this aim, a legal-dogmatic method will be used to explain the current law and the reasons behind it, as well as the background to the current regulations. In addition, the principles and their importance in criminal law and the impact of criminal policy on the legislative process will be investigated.

The conclusions drawn are that legal principles can be seen as guidance while expressing the values of the legislator, they can be overridden if another principle prevails. In this case, existing law shows that the principle of humanity takes precedence over the principle of proportionality when it comes to assessing the value of a sentence as well as the maximum penalty in the case of multiple offences. It is also shown throughout the paper that the motives behind the asperation principle are based on humanity but also on the idea of retribution and thus relative proportionality. Regarding the role of criminal policy, it cannot be excluded that politicians are the ultimate legislators and thus criminal policy becomes an important element of this. (Less)
