- Syftet med uppsatsen är att undersöka konkursförvaltarens återkallelserätt inom svensk rätt av abandonerad egendom, med utgångpunkt i NJA 2004 s. 777. Uppsatsen syftar vidare till att belysa utformningen av en framtida lagreglering gällande förhållandet mellan den fria återkallelserätten och abandonering som rättsinstitut där ett svenskt lagförslag kommer beröras samt nuvarande norsk lagreglering i frågan.
Med abandonering avses förfarandet att en konkursförvaltare under en pågående konkurs låter viss egendom utgå ur boet och istället lämnar egendomen till gäldenären som därmed återfår rådigheten över denna. Abandonering som rättsinstitut är emellertid inte något som är reglerat i den svenska konkurslagen (1987:672) och verkar inte vara... Abandonering som rättsinstitut är emellertid inte något som är reglerat i den svenska konkurslagen (1987:672) och verkar inte vara föremål för en framtida reglering. En allmän rätt för konkursförvaltaren att abandonera egendom har dock bekräftats i NJA 2004 s. 777. Rättsfallet blev emellertid föremål för kritik då HD parade den allmänna rätten till abandonering med en rätt för förvaltaren att fritt återkalla sin abandoneringsförklaring under konkursen gång.
I uppsatsen kan det konstateras att återkallelserätten som återfinns i NJA 2004 s. 777 har förorsakat en osäkerhet kring och om abandonering som rättinstitut. Trots den osäkerhet som återfinns så får rättsläget anses vara fastställt och det finns därav en rätt för konkursförvaltaren att fritt återkalla den abandonerade egendomen under konkursen gång, detta med stöd av NJA 2004 s. 777, i brist på ändrande praxis och lagreglering. I uppsatsen utröns att en ändring av rättsläget och en lagreglering vore välkomnad, både från Högsta domstolen samt från det svenska lagförslaget. I uppsatsen konstateras vidare att en möjlig utformning av lag vore att abandoneringsförklaringen ses som en ensidig viljeförklaring som utesluter rätten till återkallelse helt eller att vi i svensk rätt har kvar återkallelserätten som i Norge under reglerade former genom lagstiftning. - The purpose of the essay is to investigate the bankruptcy trustee´s right of revocation within Swedish law of abandoned property, based on NJA 2004 s. 777. Furthermore, the essay aims to shed light on a future legal regulation regarding the relationship between the right of revocation and abandonment as a legal institution where a Swedish bill will be addressed, as well as a current Norwegian legal regulation on the issue.
Abandonment refers to the procedure in which a bankruptcy trustee, during an ongoing bankruptcy, decides to transfer certain property out of the bankruptcy estate to the debtor, who thereby regain control over it. Abandonment as a legal institution is however, not something that is regulated in the Swedish Bankruptcy... Abandonment as a legal institution is however, not something that is regulated in the Swedish Bankruptcy Act (Konkurslagen 1987:672) and does not seem to be subject to future regulation. A general right for the trustee in bankruptcy to abandon property has, however, been confirmed in NJA 2004 s. 777. Yet, the court case itself became the subject of criticism as the Supreme Court paired the general right to abandonment with a right for the trustee to freely revoke his declaration of abandonment during the bankruptcy.
In the essay, it can be stated that the right of revocation found in NJA 2004 p. 777 has caused uncertainty concerning abandonment as a legal institution. Notwithstanding the uncertainty that exists, the legal situation is considered to be established and there is therefore an existing right for the receiver to freely revoke the abandoned property during the bankruptcy, this under NJA 2004 p. 777 in the absence of changing practice and legal regulation. The essay also finds that a change in the legal situation and a legal regulation would be welcomed, both from the Supreme Court and from the Swedish bill.
Moreover, the essay further states that a possible formulation of law would be that the declaration of abandonment is seen as a unilateral declaration of intent that excludes the right of revocation altogether or that in Swedish law we retain the right of revocation as in Norway under regulated forms through legislation.
