När hemma inte längre finns - En jämförelse mellan utmätnings- och avhysningsförfarandet ur ett barnrättsperspektiv

Barn som berörs av avhysning ställs i likhet med barn som drabbas av utmätning av bostad inför risken att förlora sitt hem. En trygg hemmiljö anses vara av stor vikt för barnets utveckling och främja behovet av stabilitet. Barn som befinner sig i osäkra beroendesituationer riskerar att påverkas negativt på flera plan, och upplever inte sällan stark oro och försämrat psykiskt mående.

I denna uppsats undersöks i vilken utsträckning barn som berörs av utmätning och avhysning skyddas och tillförsäkras sina rättigheter. Att utmätning- och avhysningsförfarandena utgör två skilda rättsliga processer erbjuder en intressant möjlighet att jämföra de åtgärder som vidtas. Barn som berörs av avhysning ställs i likhet med barn som drabbas av utmätning av bostad inför risken att förlora sitt hem. En trygg hemmiljö anses vara av stor vikt för barnets utveckling och främja behovet av stabilitet. Barn som befinner sig i osäkra beroendesituationer riskerar att påverkas negativt på flera plan, och upplever inte sällan stark oro och försämrat psykiskt mående.

I denna uppsats undersöks i vilken utsträckning barn som berörs av utmätning och avhysning skyddas och tillförsäkras sina rättigheter. Att utmätning- och avhysningsförfarandena utgör två skilda rättsliga processer erbjuder en intressant möjlighet att jämföra de åtgärder som vidtas. En jämförelse kommer att göras i syfte att identifiera skillnader i ansvariga myndigheters handläggning av målen.

I uppsatsen behandlas förfarandenas inledande och verkställande skeden med fokus på de tillfällen där ett barnperspektiv kommer till uttryck. Vidare behandlas central rättspraxis på området, bland annat den nyligen meddelade domen NJA 2021 s. 1065, där HD hävde utmätningen av en bostadsfastighet med hänsyn till principen om barnets bästa.

Utredningen visar att de olika förfaranderegler som tillämpas vid en utmätning respektive avhysning också påverkar vilka skyddsåtgärder som vidtas till förmån för barn. Myndigheterna ges varierande möjligheter att ingripa under förfarandenas olika skeden och en slutsats som kunde dras var att KFM som verkställande myndighet har relativt liten chans att stoppa en utmätning eller avhysning med hänsyn till skyddet för barn. Skyddsåtgärderna består istället till stor del av underrättelser till sociala myndigheter och att anpassa åtgärder så att barn berörs så lite som möjligt. (Less)

Children who are affected by an eviction are, like children affected by attachment and sale of a house due to enforceable debt, faced with the risk of losing their home. A safe home environment is considered to be of great importance for the child's development and promotes the need for stability. Studies show that children subject to unsettled housing situations tend to experience grave anxiety and an impaired mental state.
This essay examines the extent to which children affected by enforcement by attachment and sale of a house are protected and granted their rights, in comparison to children affected by eviction. The fact that the proceedings activate two separate legal frameworks offers an interesting opportunity to compare the... (More)
Children who are affected by an eviction are, like children affected by attachment and sale of a house due to enforceable debt, faced with the risk of losing their home. A safe home environment is considered to be of great importance for the child's development and promotes the need for stability. Studies show that children subject to unsettled housing situations tend to experience grave anxiety and an impaired mental state.
This essay examines the extent to which children affected by enforcement by attachment and sale of a house are protected and granted their rights, in comparison to children affected by eviction. The fact that the proceedings activate two separate legal frameworks offers an interesting opportunity to compare the measures taken. A comparison will be made in order to identify differences in the responsible authorities' handling of the cases.
The essay covers the initial and executive stages of the procedures with a focus on the occasions when a child’s perspective is expressed. Furthermore, case law relevant to the subject, including the recently announced judgment NJA 2021 s. 1065, where the Supreme Court revoked the attachment and sale of a house with regard to the principle of the best interests of the child.
The conclusion is that the procedural rules applied in the different proceedings affect which protective measures that are taken to protect the children. The authorities are given fluctuating opportunities to intervene during the stages of the proceedings and a conclusion that could be drawn was that the Swedish Enforcement Agency has a relatively small chance of averting an enforcement with regard to the protection of children in both cases. The alternative protective measures primarily consist of notifications to social authorities and adapting the procedures in order to affect children as little as possible. (Less)
