- Dataskydd och utvecklingen av lagstiftning och riktlinjer för användningen av ansiktsigenkänning är ett otroligt högaktuellt ämne världen över. Parallellt med EU:s restriktiva förhållningssätt till AI-system, vilket har resulterat i ett av världens mest omfattande rättsliga ram för integritet och dataskydd, finns ett stort intresse för ansiktsigenkänning hos både offentliga förvaltningar och privata aktörer.
Genom en diskussion om ansiktsigenkänning, dess reglering samt de etiska och juridiska problem som aktualiseras vid dess användning har det klargjorts att det råder en mycket samhällsaktuell intressekonflikt mellan de möjligheter och fördelar som tekniken erbjuder och de implikationerna som tekniken har på av grundläggande... (More) - Dataskydd och utvecklingen av lagstiftning och riktlinjer för användningen av ansiktsigenkänning är ett otroligt högaktuellt ämne världen över. Parallellt med EU:s restriktiva förhållningssätt till AI-system, vilket har resulterat i ett av världens mest omfattande rättsliga ram för integritet och dataskydd, finns ett stort intresse för ansiktsigenkänning hos både offentliga förvaltningar och privata aktörer.
Genom en diskussion om ansiktsigenkänning, dess reglering samt de etiska och juridiska problem som aktualiseras vid dess användning har det klargjorts att det råder en mycket samhällsaktuell intressekonflikt mellan de möjligheter och fördelar som tekniken erbjuder och de implikationerna som tekniken har på av grundläggande rättigheter såsom personlig integritet, dataskydd och skydd för privatlivet.
Uppsatsen belyser att privata aktörer och det civila samhället förespråkat för tydligare regler när det gäller ramarna för användningen av ansiktsigenkänning. Även inom akademin har forskning tagits fram som argumenterar för att befintlig reglering och de krav som ställs däri inte är tillräckliga för att säkerställa en tillförlitlig användning av ansiktsingekänning. Men analysen och exemplifieringen av problematiken som rör förhållandet mellan integritet och den befintliga regleringen indikerar på att riskerna förknippade med ansiktsigenkänning har hanteras inom ramen för befintligt regelverk. Eftersom regelverket är utformad för att bemöta nya utvecklingar bör vi utgå ifrån att det i framtiden även kan fortsätta bemöta problematiken och således vara anpassbar. (Less) - Abstract

Parallel with the EU's restrictive approach to AI systems, which has resulted in one of the world's most comprehensive legal frameworks for the protection of privacy and data protection, there is a great deal of interest in the use of face recognition among both public administrations and private actors.
Through a discussion of facial recognition, its regulation and the ethical and legal problems that arise in its use, the essay discusses that there is a socially relevant conflict of interest between the opportunities and benefits that the technology offers and the implications that the technology has on fundamental rights such as personal integrity , data protection and privacy.
The essay highlights that both private actors and civil society have advocated for clearer rules regarding the legal framework for the use of facial recognition. Academic research also argues that existing regulations and the requirements set out in them are not sufficient to ensure a reliable use of facial recognition. However, the analysis and exemplification of the problems concerning the relationship between privacy and regulation indicates that the risks associated with facial recognition have been met and managed within the framework of existing regulation and that it thus can continue to deal with these issues. As the regulations are designed to respond to new developments, we should assume that in the future it can also continue to address the problem and thus be adaptable. (Less)
