Abstract (Swedish)
Principen om allmänna handlingars offentlighet har varit en del av Sverige sedan 1766. Syftet är
att ge människor insyn i den offentliga förvaltningen. I praktiken betyder det att var och en kan
begära ut allmänna handlingar från myndigheter. En allmän handling i sin tur är ett dokument
som antingen är inkommit till, eller upprättat hos, en myndighet.
Då den offentliga förvaltningen blir mer digitaliserad börjar handlingar framställas på
andra sätt än genom tryckt skrift vilket medför att rättsläget gällande när särskilda typer av
handlingar ska anses som allmänna blir oklart.
Uppsatsen behandlar när ett dokument som, via en internetuppkoppling, kan redigeras,

Principen om allmänna handlingars offentlighet har varit en del av Sverige sedan 1766. Syftet är
att ge människor insyn i den offentliga förvaltningen. I praktiken betyder det att var och en kan
begära ut allmänna handlingar från myndigheter. En allmän handling i sin tur är ett dokument
som antingen är inkommit till, eller upprättat hos, en myndighet.
Då den offentliga förvaltningen blir mer digitaliserad börjar handlingar framställas på
andra sätt än genom tryckt skrift vilket medför att rättsläget gällande när särskilda typer av
handlingar ska anses som allmänna blir oklart.
Uppsatsen behandlar när ett dokument som, via en internetuppkoppling, kan redigeras,
delas och läsas i realtid ska anses som en allmän handling. Uppsatsen behandlar även hur andra
snarlika rättssystem behandlar digitala handlingar.
Slutsatsen baseras främst på den rättspraxis som finns på området och slår fast att dessa
digitala dokument som förs löpande inte blir allmänna förrän de ändrar medium genom
exempelvis att skrivas ut eller när de expedieras. Vidare leder jämförelsen med våra grannländer
bland annat till slutsatsen att lagstiftningen bör uppdateras och anpassas till ett digitalt samhälle. (Less)

As public administration becomes more digital, documents begin to be produced in other
ways than through printed text, which means that the legal situation regarding when specific
types of documents are to be regarded as public are uncertain.

the medium by, for example, being printed or when they are processed. Furthermore, the
comparison with our neighboring countries leads, among other things, to the conclusion that the
legislation should be updated and adapted to a digital society. (Less)
