Kriget i Jemen har nu pågått i sju år och FN-organisationer beskriver den humanitära situationen som den värsta i världen just nu med över 20 miljoner människor i behov av akut humanitär hjälp och för ca 11 miljoner av dessa är behovet akut.

Förenade Arabemiraten och Saudiarabien leder en militärkoalition mot Huthirebellerna i ett krig där båda sidorna i konflikten har begått brott mot den internationella humanitära rätten.

Efter ett långt utredningsarbete infördes 2018 en lagändring i lagen (1992:1200) om krigsmateriel där mottagarlandets demokratiska status och dess respekt för den internationella humanitära rätten ska spela en större vikt vid tillståndsprövningen. Kriget i Jemen har nu pågått i sju år och FN-organisationer beskriver den humanitära situationen som den värsta i världen just nu med över 20 miljoner människor i behov av akut humanitär hjälp och för ca 11 miljoner av dessa är behovet akut.

Förenade Arabemiraten och Saudiarabien leder en militärkoalition mot Huthirebellerna i ett krig där båda sidorna i konflikten har begått brott mot den internationella humanitära rätten.

Efter ett långt utredningsarbete infördes 2018 en lagändring i lagen (1992:1200) om krigsmateriel där mottagarlandets demokratiska status och dess respekt för den internationella humanitära rätten ska spela en större vikt vid tillståndsprövningen. Trots detta gick nästan hälften av de den svenska vapenexporten till icke-demokratier år 2021 och flera människorättsorganisationer har uppmärksammat att svenskt krigsmateriel kan ha använts vid övergrepp mot den humanitära rätten.

Uppsatsen ämnar rekonstruera och såväl analysera regleringen kring vapenexport med utgångspunkt i en juridisk metod. Materialet utgörs till största del av förarbeten till lagreformen till lagen om krigsmateriel, regeringens årliga skrivelser till riksdagen om strategisk exportkontroll, FN:s vapenhandelsfördrag, FN-resolutioner, EU:s gemensamma ståndpunkter, ISP:s skrivelser, och rapporter från freds och- människorättsorganisationer.

I analysen redogörs inledningsvis om lagstiftningen gällande följdleveranser kan anses vara förenlig med Sveriges internationella förpliktelser och slutligen om de exporttillstånd som beviljats till Saudiarabien och Förenade Arabemiraten kan anses bryta mot Sveriges internationella förpliktelser. The war in Yemen has now entered its seventh year and human rights organizations are describing the humanitarian crisis as the largest in the world with over 20 million people in need of humanitarian aid, the need being urgent for 11 million of them.

The United Arab Emirates and Saudi-Arabia are leading a military coalition against Houthi-led forces in a war that has seen violations agains the international humanitarian law from both sides.
After a long investigative process a new criteria was introduced the law on military equipment where the recipients democratic status and respect for the international humanitarian law will play a larger role in the licensing process. The war in Yemen has now entered its seventh year and human rights organizations are describing the humanitarian crisis as the largest in the world with over 20 million people in need of humanitarian aid, the need being urgent for 11 million of them.

The United Arab Emirates and Saudi-Arabia are leading a military coalition against Houthi-led forces in a war that has seen violations agains the international humanitarian law from both sides.

Contrary to this, almost half of the Swedish arms trade were exported to non-democraties such as The United Arab Emirates and Saudi-Arabia and many human rights organizations has warned that Swedish military equipment may have been used in violations of the international humanitarian law.

This essay aim to reconstruct and analyse the legal frame and guidelines of the swedish arms trade with the legal method. The material used in this essay is largely consisting of the preparatory work of the law of arms-material, current guidelines for the arms trade the governmental annual report of the Swedish arms control policies. The international sources being highlighted in the essay is the UN Arms Trade Treaty, UN resolutions, The common position of the EU on arms trade, reports from the ISP and reports from peace- and human rights organization.

The analysis first describes whether the legislation regarding consequential deliveries can be considered compatible with Sweden's international obligations and finally whether the export permits granted to Saudi Arabia and the United Arab Emirates can be considered to violate Sweden's international obligations.
