- Abstract
- Juvenile delinquency has become a recurring issue of debate in Sweden, which has led to an increased severity in penalties. SOU 2021:68 recently presented a legislative proposal suggesting the involvement of young people in criminal activity should be criminalized from July 2023. By examining how the need of the legislation is motivated, a main objective of this study is to gain a greater understanding of the task of preventing juvenile delinquency and criminal networks. - Juvenile delinquency has become a recurring issue of debate in Sweden, which has led to an increased severity in penalties. SOU 2021:68 recently presented a legislative proposal suggesting the involvement of young people in criminal activity should be criminalized from July 2023. By examining how the need of the legislation is motivated, a main objective of this study is to gain a greater understanding of the task of preventing juvenile delinquency and criminal networks. The study also strives to analyse how police officers perceive the legislation's future consequences, in relation to the indented effects of the law. The research questions are answered through interviews with four respondents whilst empirics were thematized using the method content analysis. In order to analyse the result Mathiesen’s theory about the intended and unintended consequences of legislation was deployed. The conclusions reveal that the legislation is justified on the need to counteract criminal networks, strengthen criminal law protection for young people and adress deviant actions with a stricter criminal law response. The respondents mainly view the legislation with positive perceptions, although they had some concerns regarding limitations in investigation and potentially counterproductive consequences. Based on the findings the legislation can be seen as a symbolic action which strives to respond to the public's sense of justice. The outcome might also digress from the legislator's intended effects. Regardless, there seems to be a need for the legislation to provide the legal system with an additional tool in the prevention of juvenile delinquency and criminal networks. (Less)
