Abstract
A Swedish Government Official Report was performed to investigate the possibility of a system with anonymous witnesses. This report examined whether incorporating anonymous witnesses could aid the legal process which otherwise may be hindered by primarily the culture of silence that exists within gang criminality. The investigation concluded that a system with anonymous witnesses should not be incorporated. A Swedish Government Official Report was performed to investigate the possibility of a system with anonymous witnesses. This report examined whether incorporating anonymous witnesses could aid the legal process which otherwise may be hindered by primarily the culture of silence that exists within gang criminality. The investigation concluded that a system with anonymous witnesses should not be incorporated. The purpose of this study is to examine Victim Support Sweden’s (Brottsofferjouren Sverige) perceptions of a system with anonymous witnesses. This study evaluates the perceptions of Victim Support Sweden on a system with anonymous witnesses and how those perceptions should be interpreted. A combination of a quantitative online-based survey and two qualitative semi-structured interviews show that coordinators, victim supporters and elected representatives consider a system with anonymous witnesses to be appropriate within the Swedish justice system. The participants in the survey are not in agreement on how extensively anonymous witnesses should be incorporated. Moreover, the results of the interviews show that the topic of anonymous witnesses is complex in regard to legal certainty. A theoretical framework regarding the relation between legality and legitimacy is used to analyze the findings. In conclusion, anonymous witnesses should be seen as a tool for the state to fulfill its mission to solve crime according to Victim Support Sweden. Furthermore, anonymous witnesses should be applied only in extraordinary cases. Arguably, the question of anonymous witnesses is complex and should be examined from multiple perspectives to elucidate how it may affect the Swedish justice system. (Less)
