Vaccinationsintyg och Europakonventionens artikel 8:s skydd för hälsa

Under Covid-19-pandemin uppstod många frågor i relation till medicinsk rätt och mänskliga rättigheter. Sverige valde en väg som hade frivillighet och rekommendationer i fokus och senare valde regeringen att införa vaccinationsbevis för att få delta på allmänna sammankomster och offentliga tillställningar. Uppsatsen behandlar relationen mellan vaccinationsintyg och Europakonventionens skydd för hälsa med fokus på artikel 8, rätt till privatliv. Det som behandlas är en kort bakgrund av vaccinations historia och hur Europakonventionen hanterar frågor om hälsa kopplat till vaccinationsintyg, det vill säga fysisk integritet och medicinsk behandling. Under Covid-19-pandemin uppstod många frågor i relation till medicinsk rätt och mänskliga rättigheter. Sverige valde en väg som hade frivillighet och rekommendationer i fokus och senare valde regeringen att införa vaccinationsbevis för att få delta på allmänna sammankomster och offentliga tillställningar. Uppsatsen behandlar relationen mellan vaccinationsintyg och Europakonventionens skydd för hälsa med fokus på artikel 8, rätt till privatliv. Det som behandlas är en kort bakgrund av vaccinations historia och hur Europakonventionen hanterar frågor om hälsa kopplat till vaccinationsintyg, det vill säga fysisk integritet och medicinsk behandling. Där kan man se att fysisk integritet är en essentiell del av rätten till hälsa och i förlängningen rätten till privatliv. Vi kan också se att det kommer skyldigheter från artikeln – dels att skydda från kroppsliga ingrepp, exempelvis vaccinering, dels att de måste agera för att invånarnas hälsa inte ska riskeras. Analysen sker genomgående, med en avslutning där jag ser till hur regeringens förslag om vaccinationsintyg går ihop med Europakonventionen. Slutsatsen blir att även om innehållet troligtvis bedöms i linje med rättigheterna så har regeringen inte gjort en ordentlig intresseavvägning och processen för antagandet kan kritiseras. Allmänt om skyddet för hälsa så kan staten kritiseras för att de inte sett till att tillräcklig information om biverkningar lämnats från vårdpersonal vilket innebär att samtycket inte är giltigt. Slutligen kan man även ifrågasätta om de, främst i början av pandemin, nådde upp till artikel 8:s och konventionens skydd för hälsa eller om staten faktiskt borde ha gjort mer och inskränkt andra mänskliga rättigheter, inklusive artikel 8, i större utsträckning för att garantera rätten till hälsa. Abstract
During the Covid-19 pandemic, many questions arose in relation to medical law and human rights. Sweden chose a path that focused on voluntariness and recommendations, and later the government chose to introduce proof of vaccination in order to participate in public gatherings and public events. The essay deals with the relationship between vaccination certificates and the European Convention's protection of health with a focus on Article 8, the right to privacy. What is covered is a brief background of vaccination history and how the European Convention deals with issues of health linked to vaccination certificates, i.e. physical integrity and medical treatment. During the Covid-19 pandemic, many questions arose in relation to medical law and human rights. Sweden chose a path that focused on voluntariness and recommendations, and later the government chose to introduce proof of vaccination in order to participate in public gatherings and public events. The essay deals with the relationship between vaccination certificates and the European Convention's protection of health with a focus on Article 8, the right to privacy. What is covered is a brief background of vaccination history and how the European Convention deals with issues of health linked to vaccination certificates, i.e. physical integrity and medical treatment. There you can see that physical integrity is an essential part of the right to health and, by extension, the right to privacy. We can also see that there are obligations from the article - partly to protect from bodily interventions, for example vaccination, partly that they must act so that the health of the inhabitants is not put at risk. The analysis takes place throughout, with a conclusion where I make sure how the government's proposal on vaccination certificates fits in with the European Convention. The conclusion is that even if the content is probably judged to be in line with the rights, the government has not made a proper balance of interests and the process for the adoption can be criticized. In general, regarding the protection of health, the state can criticize that they do not ensure that sufficient information about side effects is provided by healthcare professionals, which means that the consent is not valid. Finally, one can also question whether, especially at the beginning of the pandemic, they reached the health protection of Article 8 and the Convention or whether the state should have actually done more and restricted other human rights, including Article 8, to a greater extent to guarantee the right to health.
