The ICJ and the sea - How the ICJ adjudicates maritime border disputes

Maritima avgränsningstvister kräver uppmärksamhet- och hänsynstagande till, i varje enskilt fall, unika omständigheter. För att möta dessa krav krävs precisa och rättvisa bedömningar av ICJ för att upprätthålla rättssäkerheten. Resultatet av en ny havsgräns, vare sig det gäller uppdelning av naturresurser eller kust-sträcka, kan ha enorma effekter på de påverkade staterna. Det legala ramverket ICJ måste arbeta inom har beskrivits, av ICJ självt, som “av en väldigt generell natur” och att det “inte förser mycket vad gäller vägledning för dem som är inblandade i maritima avgränsningstvister”. Syftet med denna uppsats är att svara på ovan ställda frågor med fokus på hur ICJ värdesätter olika unika omständigheter som tillkommer i maritima av-gränsningstvister. Detta kommer att göras genom att undersöka domar av ICJ som gäller maritim avgränsning. Det framkommer av uppsatsen att ICJ:s framarbetade metod tillhandahåller skäliga resultat genom en väl genomarbetad process vilket påvisas i dem tre undersökta fallen. ”Trestegs-metoden” är kapabel till att lösa maritima avgränsningstvister genom att ta hänsyn till alla potentiella omständigheter på ett opartiskt sätt och samtidigt förevisa proces-sen. Maritime delimitation disputes demand attention to and evaluation of a substantial amount of, in every different case, unique circumstances. Meeting this demand calls for precise and equitable judgements by the ICJ to uphold legal order. The results from a new maritime border being drawn, whether it be partitioning of natural resources or a certain coastal projection, can have tremendous effects on the affected states. The legal framework the ICJ must work within, UNCLOS, has been described, by the ICJ itself, as “of a very general nature” and that the articles “do not provide much by way of guidance for those involved in the maritime delimitation exercise.”. The results from a new maritime border being drawn, whether it be partitioning of natural resources or a certain coastal projection, can have tremendous effects on the affected states. The legal framework the ICJ must work within, UNCLOS, has been described, by the ICJ itself, as “of a very general nature” and that the articles “do not provide much by way of guidance for those involved in the maritime delimitation exercise.”. To deliver fair judgements in these cases, without being able to rely on internationally agreed law, the ICJ has developed the “three-stage approach”. The question then arises, does the “three-stage approach” provide equitable results in the ICJ’s judgements and furthermore, how?
The purpose of this essay is to answer the above-stated questions, focusing on the valuation of the different possible circumstances that arise in maritime border disputes. This will be done by examining judgements by the ICJ that regard maritime border disputes. It is found that the by the ICJ created method provides equitable results through a well worked out process, exhibited in the examined cases. The “three-stage approach” is capable of resolving maritime border disputes, with regard to all possible circumstances, in an impartial manner, whilst displaying the process. (Less)
