Skärpt syn på flerfaldig brottslighet – En straffteoretisk analys av asperationsprincipen i svensk rätt

Abstract
This essay analyzes penalty reduction in case of multiple crimes. The asperation principle is the principle that is used in Swedish law in the case of multiple crimes. The principle is given importance on two separate occasions in the penalty determination. It is used both in the construction of a joint penalty scale and in the penalty value assessment. According to the principle, the crimes are graded in degree of severity, whereupon an assessment of the penalty value is made for each individual crime. The starting point for the application of the asperation principle is then the penalty value for the concretely most serious crime, where a diminishing addition is made for the penalty value of the subsequent crimes.

This essay analyzes penalty reduction in case of multiple crimes. The asperation principle is the principle that is used in Swedish law in the case of multiple crimes. The principle is given importance on two separate occasions in the penalty determination. It is used both in the construction of a joint penalty scale and in the penalty value assessment. According to the principle, the crimes are graded in degree of severity, whereupon an assessment of the penalty value is made for each individual crime. The starting point for the application of the asperation principle is then the penalty value for the concretely most serious crime, where a diminishing addition is made for the penalty value of the subsequent crimes.

The purpose of the essay is partly to give an account of the current regulatory framework for penalty reductions for multiple crimes and partly to examine how a possibly stricter view on penalty reduction relates to different theories of punishment and criminal law principles. The theoretical framework is mainly based on the theories of general prevention and individual prevention as well as the principles of proportionality, equivalence and humanity.

The conclusion is that a stricter view of multiple criminality in terms of penal theory is probably in line with the theories of general prevention and individual prevention. However it is pointed out that there is a lack of evidence that a higher level of repression has a deterrent effect and that it often has the opposite effect, which is why one can question whether these punishment theories can justify reduced sentence reductions. Furthermore, a stricter view of multiple criminality would be contrary to the principles of proportionality, equivalence and humanity. If a stricter view means a statutory order for the penalty value assessment, the court's flexibility will be reduced when assessing the individual case. A changed system would also entail a risk that the reaction to multiple crimes would be unreasonably severe. However, it can also mean a more uniform system that gives rise to predictability in the administration of justice. (Less)

Detta arbete behandlar frågan om straffreduktion vid flerfaldig brottslighet. Asperationsprincipen är den princip som tillämpas i svensk rätt vid flerfaldig brottslighet. Principen ges betydelse vid två skilda tillfällen i påföljdsbestämningen. Den används vid såväl utformningen av en gemensam straffskala som vid straffvärdebedömningen. Enligt principen graderar man brotten i svårighetsgrad där man sedan gör en bedömning av straffvärdet för varje enskilt brott. Utgångspunkten vid tillämpningen av asperationsprincipen är sedan straffvärdet för det konkret svåraste brottet, där man sedan gör avtagande tillägg för straffvärdena av de efterföljande brotten.

Uppsatsens syfte och frågeställningar besvaras således ur ett straffteoretiskt perspektiv.

Slusatsen är att en skärpt syn på flerfaldig brottslighet rent straffteoretiskt troligtvis ligger i linje med teorierna om allmänprevention och individualprevention. I framställningen påpekas dock att det saknas belägg för att en höjd repressionsnivå får avskräckande verkningar och att det ofta får motsatt effekt, varför man kan ifrågasätta om dessa straffteorier kan motivera minskade straffreduktioner. Vidare torde en skärpt syn på flerfaldig brottslighet innebära ett avsteg från principerna om proportionalitet, ekvivalens och humanitet. Om en skärpt syn innebär en lagfäst ordning för straffvärdebedömningen kommer domstolens flexibilitet att minska vid bedömning i det enskilda fallet. Ett förändrat system hade vidare medfört en risk för att reaktionen på flerfaldig brottslighet blir oskäligt sträng. Det kan emellertid också innebära ett mer enhetligt system som ger upphov till förutsebarhet i rättskipningen. (Less)
