Diskrimineringslag (2008:567) trädde i kraft den 1 januari 2009. Lagen erbjuder ett bestämt antal avskilda grunder som en missgynnande handling behöver ha samband med för att diskriminering ska kunna anses föreligga. Diskrimineringsgrunderna utgör avskilda kategorier och kan varken kombineras eller adderas. Kategorierna utgörs av kön, könsöverskridande identitet eller uttryck, etnisk tillhörighet, funktionsnedsättning, sexuell läggning och ålder. Intersektionalitet har länge varit ett uppmärksammat perspektiv som inom samhällsvetenskapliga fält beskriver maktordningar och (o)jämlikhet utifrån den simultana verkan av flera olika kategorier. Diskrepansen däremellan har föranlett uppsatsens tillblivelse.

Diskrimineringsgrunderna utgör avskilda kategorier och kan varken kombineras eller adderas. Kategorierna utgörs av kön, könsöverskridande identitet eller uttryck, etnisk tillhörighet, funktionsnedsättning, sexuell läggning och ålder. Intersektionalitet har länge varit ett uppmärksammat perspektiv som inom samhällsvetenskapliga fält beskriver maktordningar och (o)jämlikhet utifrån den simultana verkan av flera olika kategorier. Diskrepansen däremellan har föranlett uppsatsens tillblivelse.

Framställningen syftar till att undersöka hur ett intersektionellt perspektiv på lagens tillämpning kan bidra till att bättre begripa dess funktionalitet. För att genomföra studien har en rättsdogmatisk och rättssociologisk metod använts. Materialet har bestått av Diskrimineringsombudsmannens tillsynsbeslut som analyserats utifrån ett intersektionellt perspektiv.

Diskrimineringsombudsmannens tillsynsbeslut kan ifrågasättas genom en jämförelse med omvärldsiakttagelser. Besluten kan beskrivas som icke-intersektionella, innebärande att prövningen enbart omfattar en ensam diskrimineringsgrund och att andra belastande tillhörigheter förblir dolda. Observationerna kan tillföra förståelse för diskrimineringslagens funktionalitet på två sätt. Perspektivet kan åskådliggöra lagens yttre gränser för vad som tillåts utgöra en del av prövningsramen. Därutöver kan perspektivet också redogöra för de förhållanden lagens endimensionella analys osynliggör och som därigenom förblir dolda. Ett intersektionellt perspektiv kan därför användas som ett analytiskt verktyg för att bättre förstå diskrimineringslagens roll i samhället, och samhällets roll för diskrimineringslagen. (Less)

The Discrimination Act (2008:567) entered into force on the 1st of January 2009. The act offers a set number of separate grounds with which a disadvantageous action needs to have a connection for discrimination to be considered present. The grounds for discrimination constitute separate categories and can neither be combined nor added. The categories consist of gender, gender identity or expression, ethnicity, disability, sexual orientation, and age. The Discrimination Act (2008:567) entered into force on the 1st of January 2009. The act offers a set number of separate grounds with which a disadvantageous action needs to have a connection for discrimination to be considered present. The grounds for discrimination constitute separate categories and can neither be combined nor added. The categories consist of gender, gender identity or expression, ethnicity, disability, sexual orientation, and age. Intersectionality has long been an attention-grabbing perspective that, within social science fields, describes power structures and (in)equality based on the simultaneous impact of several different categories. The discrepancy between the Discrimination Act and social science has prompted the creation of the essay.

The composition aims to investigate how an intersectional perspective on the application of the Act can contribute to a better understanding of its functionality. To carry out the study, a legal dogmatic and legal sociological method has been used. The material has consisted of the supervisory decisions of the Equality Ombudsman, analyzed from an intersectional perspective.

The supervisory decisions of the Equality Ombudsman can be questioned through a comparison with external societal observations. The decisions can be described as non-intersectional, meaning that the reviews only include a single discrimination ground and that other burdensome attributes remain hidden. The observations can add understanding to the functionality of the Discrimination Act in two ways. The perspective can illustrate the outer limits of the law, concerning that which is allowed to take part in the framework of the reviews. In addition, the perspective can also explain the conditions that the one-dimensional analysis of the Discrimination Act make invisible, and which thereby remain hidden. An intersectional perspective can therefore be used as an analytical tool to better understand the role of the Act in society, and society's role for the Act. (Less)
